On this 30th day of October AD 1832 personally appeared in open Court of Common Pleas now sitting written and for the County of Licking aforesaid before the Judges then of the Daniel Boyer resident of Newton Township in said County. Aged seventy seven years on the 9th day of March 1756 was born in Kent County State of Delaware his age was recorded in his fathers Bible but which of his fathers children has it he is unable to say. Who being duly sworn in open Court doth on his oath make the following Declaration in order to obtain the benefit of the provision made by the act of Congress of the 7th of June 1832. That he entered the service of the United States by enlistment for six months at his own house in Kent County Delaware on the 1st June 1776 that he served in the Company commanded by Capt. Joseph Caldwell in the 2nd Delaware Regiment as a sergeant joined the Troops at Dover in said state. Thence they marched to Christene Bridge remained there two or three weeks. Thence to Woodbridge New Jersey from thence in a short time to Fort Lee on the Hudson River (the troops being under the Command of Gen'l Mercer). In about a month afterwards they were ordered to Amboy here we remained until the 1st of Dec 1776 during the time the troops were stationed at Amboy they were crossed over to Staten Island and had a skirmish with the British took eighteen prisoners the British were driven back on the last day of his time of enlistment Lord Cornwellis came on and after some fighting with our troops they took possession of the place. States that he was discharged at Philadelphia having marched on with his Company to that place, rec'd a written discharge signed by Col. Patterson, which has been long since lost, or distroyed. He states that he was acquainted with the officers of his regiment - Col. Samuel Patterson, Major Henry Neal, and Capt. Joseph Caldwell - Peter Loper 1st and 2nd Lieut. Coe Cordy Despondent states that he afterwards rec'd a commission signed by Caesar Rodney Governor of State of Delaware in February 1777 as Lieutenant and was stationed on the Beach on Jones Neck toward the Coast. Had the command of twenty-five men and remained on duty from the first of April until sometime in the month of October. When he was discharged from that post six months and more, that he continued to hold said commission for two years and had the command of the Minute Men to guard the coast bordering upon the state of Delaware and for most of the time during the said two years he was actively engaged on duty along the coast to prevent the enemy from landing and coming up robbing and plundering the farmers bordering along the coast. Has no documentary evidence nor does he know of any persons by whom he cape make further proof. He duly relinquishes every claim whatever to a pension or annuity except the present and declares that his name is not on the pension Roll of any agency in any state (signature DANIEL BOYER) from to and subscribe in open court A, H, Coffee ck We Samuel Fogger and Caleb Boyer both residing in Newton Township Licking County Ohio do certify that we are well acquainted with Daniel Boyer who has subscribed and sworn to the above Declaration that we believe him to be about seventy seven years of age that he is reputed and believed in the neighborhood where he resides to have been a soldier in the Revolution and served as he states and we concur in that opinion Signature SAMUEL FOGGER CALEB BOYER And the Court do hereby declare our opinion after an investigation of the matter and putting the interigatered prescribed by the War Department that the above named applicant was a revolutionary Soldier and Served as he States --- That he is entitled as near they can determine from his statement to a pension for one years service - without including the time in which he says he was employed along the coast. Be the length of which he does not state with sufficient presuison - And that he Court further certified that Samuel Foggar and Caleb Boyer (who have signed & sworn to the above certificate) and that they are credible persons, and that their sealment above is entitled to credit obelus I Amos H Caffee Clerk of the said Court do hereby certify that the foregoing contains the original proceedings of the said Court in the matter of the application of Daniel Boyer for a pension (there was no clergyman in the neighborhood who could testify in favor of said Boyer in testimony where of I have hereunto sat my hand and seal of said Court this 3rd day of December AD 1832 Signature A H CAFFEE ck The State of Ohio Licking County The above named Daniel Boyer personally appeared before me the subscribe a Justice of the Peace for said county of Licking whole being duly sworn saith in addition to an in a explanation of his declaration as to the first objection to ?? ???? of his claim - there was no officers of a higher grade than Lieutenant on the service in as much he was employed on the coast and none ??? man higher than a sergeant - He was appointed under and commissioned by the Governor and remained in service under a law of the State of Delaware, it not less than six months. He cannot now produce any commission it has long been lost or destroyed, nor can he produce two living witnesses to swear that he was a Lieutenant - He can produce the deposition of a woman of respectable character who knows that he was out, and served as Lieutenant as believes, but this is all the proof he could get in this country and he knows of none where he formerly lived. Not knowing Whittier the ???? ???? would be if any avail he has not taken the trouble to get it to establish his claim as a Lieutenant. If under present circumstances he cannot have his claim admitted as a Lieutenant he hopes it may be admitted as a private and therefor claims a pension for the following period of service viz - six months as secondly within mentioned making in all one years service & for then he claims a pension relinquishing all else. Deponent states that he was well acquainted with Captain Allen McLane of Delaware who if he was now living could testify as to his service, but he ???? ????? understand he is dead. There us no clergy man in his neighborhood who can testify as to the belief of his age & service but in lieu there of have produced the affidavit of two respectable citizens to that effect.
