Perkins Case # 1236 Files Knox County Ohio Probate records October 11, 1909 Granted November 5th 1909 By Patrick A. Berry Will and proof in margin page 116 In the matter of the will of Nathaniel P. Perkins, deceased Court of Probate Knox County Ohio Thursday, March 20, 1897 An instrument of writing, purporting to be the last will of Nathaniel P. Perkins, later of Milford Township, in this county, deceased, was produced in open court for Probate; It is now ordered that the said will be filed in this court. And that due notice thereof, and the application to admit the same to probate and record, be given to the widow and next of kin of the testator resident of the State of Ohio, and that said application will be for hearing before this court, on the 27th day of March 1897 at 9 o’clock a. m. In the matter of the will of Nathaniel P. Perkins, deceased This matter came on this day further to be heard, on the application of William Perkins to admit to probate and record the will of Nathaniel P. Perkins, deceased, heretofore filed in this court therefore and it now being shown to the satisfaction of the court that due notice of the filing of said will and of the application to admit it to probate and record in this court have been given to the widow and next of kin of said testator residents of Ohio and David F Ewing and John D.Ewing the subscribing witnesses to sail will having this day appeared in open court, and having been duly sworn, testified to the due execution and attestation of said will, which testimony was reduced to writing, was inscribed by them respectively, and was filed with said will. Whereupon the court finds that the aforesaid instrument of writing is the last will and testament of said Nathaniel P. Perkins deceased; that it was duly executed and attested, that the said testator at the time of signing said will was of lawful age of sound mind and memory, and not under any restraint. It is therefore by the court ordered that the said will be admitted to probate, and that it together with the said testimony of the witness above named, be entered of record in this court. WILL In the name of the benevolent father of all I Nathaniel P. Perkins of Milford Township of Knox County, Ohio do make and publish this my last will and testament, Item 1st; I desire that all of my just debts be paid out of my estate. Item 2nd; I give and devise to my beloved wife in lien of her dower all my real estate consisting of about one hundred and twenty eight acres all situated in Milford Township, Knox County Ohio during her natural life. Item 3rd; I give and bequeath to my beloved wife two cows and one horse and one buggy and buggy harness to be hers absolutely, Item 4th; I give and bequeath to my daughter Mary Trout one hundred dollars to be paid to her out of m estate in two years after the death of my said wife. Item 5th; I give to my daughter Martha Miles one hundred dollars to be paid to her out of my estate in four years after the death of my said wife. Item 6th; I give and bequeath to my grandson William Myers one hundred dollars to be paid out of my estate in six years after the death of my said wife. Item 7th; At the death of my said wife I give to my son William H.V. Perkins all of my estate of every description subject to the payment of bequests made in items 4-5-6 which items shall not bear any interest until the time fro the payment of them shall elapse. Item 8th; I do hereby nominate and appoint my said son William H. V. Perkins, executor of this my last will and testament hereby authorizing and empowering him to compromise, adjust, release and discharge in such manner as he may deem proper and just the debts and claims due me. I do also authorize and empower him if it shall become necessary in order to pay my debts to sell by private sale or in such manner, upon such terms of credit or otherwise as he ma think proper all or any part of my real estate and deeds to purchasers to execute acknowledge and deliver fee simple. I desire that no appraisement of my estate be made and that my said execution be not required to give bond as such I do hereby revoke all former will by me made. In testimony here of I have hereto set my hand and seal this 24th day of October in the year 1896. Nathaniel P. Perkins (seal) Signed and acknowledged by said Nathaniel P. Perkins legatee has complied with the items of this will in Items 4-5 and 6. See final record No 21 page 50 file Box 354 No.1236 Application of William H. V. Perkins residuary legatee under the last will and testament of Nathaniel P. Perkins, deceased, to clear real estate of encumbrances created by said will. Now come William H. V. Perkins and respectfully represents to the court that by the terms of the last will and testament of said Nathaniel P. Perkins, deceased, which was duly admitted to probate and recorded in said court March 27, 1897, and recorded at page 116 of Will Record K of the records of said court, that said testator provided in Items 4, 5 and 6 thereof for the payment of $100.00 each to Mary Trout, Martha Miles and William Myers, making the same a charge upon the real estate devised by said last will and testament and further providing in said will that after the death of his wife, that all of his said estate subject to the payment of his debts and liabilities as well as said legacies above mentioned should pass and vest in the undersigned William H. V. Perkins. Your Applicant further represents that Catherine Perkins, Wife of the said Nathaniel P. Perkins, departed this life on or about the 9th day of November, 1906, and that in accordance with the terms of said will this applicate has paid all of the debts and liabilities of said estate as well as the legacies made payable to Mary Trout, Martha Miles, and William Myers and has fully complied with the terms of said will in regard thereto, as will more fully appear by the first and final account filed by this applicant, together with the receipts as evidence of said payments.
