Courthouse, Toledo, Ohio Written: November 23 1889 Recorded: December 2 1889 Will of William H. Moore, Dec'd. Record of proceedings had by and before the Probate Court of Lucas County Ohio in the matter of admitting to Probate the last will and testament for William H. Moore, late of Auburndale, in said County, deceased, begun on the 2nd day of December, A.D. 1889. On which day the following order of Court and journal entry was made. ----------------------------------Order-------------------------- Probate Court, Dec. 2nd, 1889 In the matter of the last Will and Testament of William H. Moore dec'd. This day was presented to the Court for Probate an instrument of writing purporting to be the last will and testament of William H. Moore, late of Auburndale, Lucas County Ohio. Ordered by the Court, that notice of said application issue to the widow and next of kin, of said decedent resident of the State of Ohio and the same was set down for hearing for the third day of December 1889 at 10 o'clock A. M. Afterward to wit on the third day of December 1889 it appearing to the Court that notice of the time of hearing had been duly given herein this cause came on to be heard. And therefore in obedience to notice same Harry E. King and J. M. Rakestraw, the subscribing witnesses to said will, and were duly sworn and examined in open Court, touching the execution of the same and their testimony was reduced to writing. And the Court finds from the testimony of said subscribing witnesses that the said testator at the time of executing said will was of full age and of sound mind and memory and not under any restraint, and that they signed as witnesses to said will in the presence said testator, and by his special request, and also in the presence of each other. Whereupon the Court considered said will to be legally proved, and the same was there upon approved and ordered to be recorded in the Probate Record of Wills of Lucas County Ohio together with the testimony. ----------------------------------------------Will------------------------------ In the name of the Benevolent Father of all, amen. I William Hammond Moore, of the town of Auburndale, County of Lucas, and State of Ohio, being about 49 years of age, and being of sound and disposing mind and memory, do make, publish and declare this my last Will and Testament, hereby revoking and null and void all other last Wills and Testaments by me made heretofore. First- My Will is that all my just Debts and funeral expenses shall be paid out of my estate as soon after my decease as shall be found convenient. Second- I give, devise, and bequeath to my son, Waldo E. Moore, all my stock of drugs, school books, stationery, confectionery, tobacco and cigars; together with the soda fountain and apparatus complete, iron safe, merchandise, sundries and all the store fixtures and furniture, now and at the time of my death in and about the storeroom at the corner of Monroe Street and Milburn Avenue, in Auburndale, Lucas County, Ohio, and known and called Moore's Drug Store. Third- I give, devise and bequeath to my three children, Dora E. Lindecker, Ina M. Moore and Waldo E. Moore, the following personal property to be divided among them as they shall agree to wit: One Black Walnut Bedroom suite with mattress springs, feather bed and pillows; one yellow bed-stead and one single bed stead with springs, feather bed and one pair of pillows. My silver knives, spoons and forks marked L. A. M. My gold watch, gold watch chain and gold ring; all family pictures; my upholstered arm chair; my melodeon [button accordion] one large old fashioned bureau; my mother's rocking chair, two small heating stoves, and one half of all bedding exclusive of that herein above described; each and all of said property now being in my home on Monroe street. Fourth- I give, devise and bequeath to my beloved wife, Sarah Moore, all the rest and remainder of my household goods, utensils and furniture, useful or ornamental, pictures, books and furnishings of every kind, whatsoever not disposed of in Item three for herself, intending hereby to bequeath the remainder of my household effects now or at the time of my death in my home on said Monroe street. Fifth- It is my will that any other of my property or effects remaining after the satisfaction of the above specific bequests shall pass and descend according to the laws of the State of Ohio and be distributed in accordance therewith. Sixth- I hereby make, constitute and appoint James D. Bowers of Toledo, Ohio, executor of this my last Will and Testament. Seventh- I hereby make, constitute and appoint my son-in-law- Joseph C. Lindecker, of Auburndale, Ohio, the Guardian of my son, Waldo E. Moore, during his minority. In testimony whereof I have set my hand to this, my last Will and Testament, at Auburndale, Ohio, this twenty third day of November in the year of our Lord one thousand eight hundred and eighty nine. William Hammond Moore The foregoing instrument was signed by the said William Hammond Moore in our presence and by him published and declared, as and for his last Will and Testament and at his request and in his presence, and in the presence of each other, we hereunto subscribe our names as attesting witnesses, at Auburndale, this twenty third day of November, A.D. 1889. Bowers, you are hereby commanded to notify Sarah Moore, Dora Lindecker, Ina Moore, and Waldo Moore, giving at least one day's notice; that on the 2nd day of December A.D. 1889, an instrument of writing purporting to be the last Will and testament of Wm. H. Moore, late of Washington Township in said County, deceased, was produced in open Court, and an application to admit the same to probate was on the same day made in said Court. Said application will be for hearing before this Court on the 3rd day of December A.D. 1889 at 10 o'clock A.M. Herein fail not, but of this writ and service thereon make due return. He is my great great grandfather and is buried in the Woodlawn Historic Cemetery. He was a Sergeant in Captain Henry Belknap's Company (B) of the 3rd Battalion 18th Regiment of United States Infantry during the Civil War.
