All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/oh/ohfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Sara Kelly Edward.F.Kelly@verizon.net February 24, 2004, 4:34 pm Sterling Written: January 28 1828 This indenture made and concluded the 28th Day of January Anno Domini 1828 between George RICHARDSON of Meigs County of the State of Ohio of the one part and David BARBER merchant of the same county and state of the other part with (cannot read microfilm)....other said George Richardson is indebted to KNOX and MCKEE of Wheeling of Virginia in the sum of four hundred dollars and for the payment of which he hath given them his bond or single bill payable in ninety days after date and whereas the said George RICHARDSON is desirous of securing the payment of the same Now these present witnesseth that the said George RICHARDSON for and in consideration of the premises and of the sum of five dollars to him in hand paid by the said David BARBER the receipt whereof is hereby acknowledged hath and by these present doth give grant bargain sell and assign unto the said BARBER all the following described property (Viz) all his stock of Groceries Goods Wares and Merchandize now in or belonging to his store at Sterling together with two Mares two cows /steer a cart compleat for two horses one plow Also all the rest and residue of his farming and stock and utensils with all his books and household furniture of every description to have and to hold the same unto the said BARBER and assigns forever upon Trust nevertheless and with the intent that if the said RICHARDSON shall fail or omit to pay the said Four hundred Dollars when the same shall become due and payable then and in that case the said BARBER being directed by the said KNOX and MCKEE so to do shall having first given ten days notice of the time and place of sale by an advertisement thereof posted on the Door of the Court house for said County Meigs proceed to sell at the said place called Sterling to the highest and best bidder for ready money the Goods wares and merchandize and property aforesaid or such part thereof as the said Trustee Barber can then find and out of the proceeds of the said thereof he-said BARBER shall first pay the costs of sale and this Deed and 2ndly the amount of said Debt of four hundred dollars and interest then due thereon or whatever part of said Debt may then to wit at the time of said sale be due and unpaid he said BARBER shall pay to said KNOX and MCKEE on order and lastly he shall pay the balance if any to the said George RICHARDSON on order. It is understood and agreed that the said Goods Wares and Merchandize and property aforesaid all to be and remain in the possession of the said George RICHARDSON until such time as the said KNOX and MCKEE shall order or cause the same to be sold. It is also understood and agreed that the provisions of this Deed are to cease and determine unto the said Deed to be void whenever the said RICHARDSON shall pay the said four hundred and any interest thereon In testimony whereof the said George RICHARDSON hath hereunto set his hand and his seal affixed the day and year above written~~~~ Signed Sealed and Delivered in the presence of us Elias W.
