Brewster, Judge of the Court of Probate for and within the County of Meigs and State of Ohio, at a session of said Court begun and held at the court house in the City of Pomeroy on the 18th day of January AD1881. In the matter of the Will of John Price deceased. Motion to admit will to Probate and Record. Be it remembered that heretofore to wit: On the 17th day of November AD1880, came Mary Price widow of John Price deceased by J. Cartwright her attorney and produced to the court an instrument of writing purporting to be a copy of the Last Will and Testament of John Price late of Clifton, Mason County, West Virginia deceased and the probate thereof also her motion that said Will and Certificate of Probate be admitted to record herein. It is therefore ordered that said Motion be set for hearing on the 18th day of January AD1881 at 10 o'clock AM and that Notice thereof be given as required by law. And afterwards to wit: on the 18th day of January AD1881 the following Notice and Proof of Publication was filed herein to wit: State of Ohio Meigs County SS} In the Probate Court in the matter of the Last Will of John Price deceased. Notice is hereby given to all persons interested therein that Mary Price, widow of said John Price and a legatee in said Will on the 17th day of November AD1880 produced in the Probate Court of Meigs County an authenticated copy of the last will of John Price deceased together with an authenticated copy of the Probate thereof, as the same are of record in the County Court of Mason County in the State of West Virginia: and that Mary Price at the same time filed her motion in said Probate Court to have said authenticated copy of said will and the probate thereof so authenticated admitted to record in said Probate Court of Meigs County. Said motion has been continued for hearing and will be finally heard on the 18th day of January AD1881 at 10 o'clock in the forenoon of that day. By J. Cartwright, her attorney Mary Price Proof of Publication E.S. Trussell being duly sworn, deposeth and saith, that he is one of the publishers of the Meigs County Telegraph, a newspaper of general circulation, published weekly in Pomeroy, Meigs County, Ohio: and that the annexed advertisement was published in said paper 6 consecutive weeks, the last publication being on Wednesday, the 22nd day of December AD1880 and further deponent saith not. E.S. Trussell Sworn and Subscribed before me this 18th day of January AD1881 Robt. H. Brewster Probate Judge And thereupon to wit: on the 18th day of January AD1881 came Mary Price by J. Cartwright her attorney and filed in this court said copy of the Will of John Price deceased and Probate which are in the words and figures following to wit: I John Price of the town of Clifton, County of Mason and State of West Virginia make this my Last Will and Testament. I give devise and bequeath my estate and property real and personal as follows. That is to say to my wife Mary Price all my real estate situated and being in Pomeroy, Meigs County Ohio and described as follows. Lots no 271 and 272 being the lots of Rees E. Williams and wife and recorded in Vol 27 pages 49 and 50 of the Records of Deeds Pomeroy Meigs County Ohio. I also bequeath to her the said Mary Price my wife, the following personal property as follows, all of the stock belonging to me which I hold in the Excelsior Salt Company doing business in Meigs County Ohio, also all the stock which I hold in the German Salt Company of Mason County West Virginia. The condition of the above will is such that so long as she remains my widow she is to hold and use as her own the property both real and personal which I have named in the will, but in the advent of her remarriage then all of the said property herein mentioned shall be divided equally among my children. I appoint Roger B. Rees of Clifton Mason County West Virginia, executor of this my will. In witness whereof I have signed and sealed and published and declared this instrument as my will. Given at Clifton Mason County on this 9th day of June AD1877. Rees An order made in vacation West Virginia SS In the clerks office of the County Court of Mason County November __ 1877 a writting purporting to be the Last Will and Testament of John Price deceased late of Mason County West Virginia was this day produced in said office and fully proved according to law by the oaths of Rees E. Williams and Roger B. Rees two subscribing witnesses thereto and thereupon the said writing is ordered to be recorded as and for the Last Will and Testament of the said John Price deceased in due form. E. Kimberling Clerk State of West Virginia County of Mason} To Wit: I JPRB Smith, clerk of the Mason County Court in and for the County and State aforesaid do certify that he foregoing Will of said John Price deceased and the Probate thereof is a true copy as taken from the records in my said office. In testimony whereof I have hereinto subscribed my name and affixed the seal of said court at Point Pleasant Mason County West Virginia this 2nd day of December 1879 JPRB Smith Clerk Mason County West Virginia and thereupon to wit: on the 18th day of January AD 1881 came Mary Price a legatee in last will and being a person interested therein having by her attorney on the 17th day of November AD 1880 produced to the Probate Judge of Meigs County Ohio a duly authenticated copy of the last will of said John Price with the probate thereof and having at the same time filed her motion in the Probate Court of said Meigs County for the purpose of having such authenticated copy of said last will together with the Probate thereofas made and of record in the County Court of said Mason County allowed and admitted to record in said Probate Court and which motion was continued till and set for hearing on the 18th day of January AD 1881 at the hour of ten o'clock AM of said day. Now at the time set as aforesaid for the hearing of said motion came the said Mary Price by her attorney J. Cartwright and made proof of the due publication of the notice of filing and pendancy of said motion as required by law for six weeks consecutively the first publication being more than 40 days beforethe said 18th day of January AD 1881 in the Meigs County Telegraph a public newspaper printed and of general circulation in said County of Meigs. And it being made to appear to said Probate Court on the hearing of said motion, that the said authenticated copy of said last will and probate thereof ought to be allowed in this state. It is therefore ordered by said Probate Court that the said authenticated copy of said last will with the Probate thereof be filed and recorded in said Probate Court. Robt. H.
