Transcribed by Sandra Lake Lassen, February 1994 This Indenture made this twenty Sixth day of June in the year of our Lord one thousand eight hundred and thirty four by and between Moses Frazee Sen & prissilla his wife of the County of Miami and State of Ohio of the one part and Lewis D Frazee of the County and State aforesaid of the other part Witnesseth, that the Said Moses Frazee and Prissilla his wife for and in Consideration of the Sum of twelve hundred dollars to them in hand paid, the receipt whereof they do hereby acknowledge, have given granted bargained Sold released and conveyed and do by these presents give grant bargain Sell, release, convey and confirm unto the Said Lewis D Frazee his heirs and assigns forever all that tract or parcel of land Situate in the County & State aforesaid it being a part of the North West quarter of Section nine in Town two Range Eleven MRS beginning at the North West Corner of Said Quarter thence East with the North line of Said quarter 48 poles to a Stake Thence with the County Road S.[?] E.90 poles to a Stone. thence East 62 poles to a Stone thence 70 80/100 poles to a Stone in the South line of Said quarter, thence with the South line West 94.16 poles to a Stone in the before mentioned road thence South 80. poles to a Stone in the line between the Said Frazee and Mitchells lands thence West 66.00 poles to the West line of the South West quarter of Said Section thence with Said line 190 poles to the place of beginning Containing 93.05/100 Acres To Have and to Hold the premises aforesaid, with all the privileges and appurtenences thereunto belonging, or in any wise appertaining unto him the Said Lewis D. Frazee and unto his heirs and assigns forever, and the Said Moses Frazee Sen and Prissilla his wife for themselves and for their heirs executors and administrators Covenant and promise to and with the Said Lewis D Frazee his heirs and assigns that they the Said Moses Frazee Sen and Prissilla his wife are lawfully Seized of the premises aforesaid thta they have good right and lawful authority to Sell and Convey the Same in manner aforesaid and that the premises are free and clear of and from all incumbrances whatever and further that the Said Moses Frazee Sen and Prissilla his wife will well and truely Warrant and forever defend the premises herein and hereby granted unto the Said Lews D Frazee and to his heirs and assigns against the lawful claims and demands of all and every person whomsoever In testimony whereof the Said Moses Frazee and Prissilla his party of the first part, have hereunto Set their hands and Seals, the day and year above writen Signed Sealed and Delivered Moses Frazee Sen [seal] In the presence of (his mark) David Frazee John H Wolcott The State of Ohio Miami County [seal] on the twenty Sixth day June AD. 1834 before the Subscriber a Justice of the peace within and for Said County personally appered the Said Moses Frazee and Prissilla Frazee who Signed and Sealed the foregoing Deed and acknowledged the Signing and Sealing thereof to be there act and deed for the purposes therein expressed and the Said Prissilla Frazee being by me examined Seperate and apart from her husband She did declare that She Excuted above Deed freely and not from threats or constraint of her husband Given under my hand and Seal the date above writen John Wolcott Entered the 21st November 1834 Justice of the peace and recorded the 2nd December 1834 Z Riley Re'd ---------------------------------------------------- Compiler's note: David Frazee, witness, is another son of Moses and Priscilla. Lewis D. Frazee married Rebecca Wolcott. John Wolcott could be her father, although I have not yet found their marriage record.
