YATES TO MARY YATES ------------------------------------ DEED BK. 14, PAGE 483, 15 SEPT. 1836, TROY TWP., MIAMI CO., OHIO Transcribed verbatim by Sandra Lake Lassen, February 1994 This Indenture made this fifteenth day of September in the year of our Lord one thousand eight hundred and thirty Six between Thomas J Yates of the County of Miami and State of Ohio of the one part, and Mary Yates of the County and State aforesaid of the other part Witnesseth that the Land Thomas J. Yates for and in Consideration of the Sum of fifteen hundred dollars, to him in hand paid, the receipt whereof is hereby acknowledged, have given, granted, bargained, sold released and Conveyed and do by these presents, give, grant, bargain, Sell, release, Convey and Confirm unto the Said Mary Yates her heirs and assigns forever all that Tract or parcel of land Situate in the County of Miami &State of Ohio bounded as follows Beginning in the West line of Section thirty four township two in Range eleven MBoTen Chains and Sixy two links North from the South West Corner of the North west quarter of Said Section from thence S 89 degrees 42 E. 80.15 Chains to the East line of Land Section thence N 1 degree 09' E.9.91 Chs to James Wetherhead Corner thence with the Said Wetherhead line N.88 degrees 84' W.26.81Chains to a Corner on the Creek thence N 47 degrees W.25 links to aCorner thence S.89 degrees 45' W.43.52 Chains to a Stake in the West line of Said Section thence S.10' W.10.40 Chs to the place of Beginning Containing 85 acres deeded by the Said Thomas J. Yates to to the Said Mary Yates in Lieu of Dower To have and to hold the premises aforesaid with all the privileges and appurtences thereunto belonging or in any wise appertaining unto her the Said Mary Yates and unto her heirs and asigns forever and the Said ThomasYates for himself and for his heirs Executor and adminsitrators Covenant and promise to and with the Said Mary Yates her heirs and assigns that he the Said Thomas J Yates is lawfully Seized of the premises aforesaid that he has good right and lawful authority to Sell and Convey the Same in manner aforesaid and that the premises are free and Clear of and from all incumbrances whatsoever and further that he the Said Thomas J Yates will well and truly Warrant and forever defend the premises herein and hereby granted unto the Said Mary Yates and to her heirs and assigns against the lawful Claims and demands of all and every person whomsoever. In Testimony whereof the Said Thomas J. Yates party of the first part have hereunto Set his Hand and Seal the day and year above written Signed Sealed and delivered Thos J Yates [seal] In the presence of Nancy Yates [seal] John H Wolcott Wm J Wolcott John Webb [more on following page] State of Ohio Miami County [Seal] on the fifteenth day of September AD. 1836 befor the Subscriber a Justice of the Peace within and for Said County personally appeared the Said Thomas J.Yates who Signed and Sealed the foregoing Deed and acknowledged the Signing and Sealing thereof to be his act and Deed for the uses and purposes therein expressed Given under my hand and Seal the date above writen John H Wolcott Justice of the Peace The State of Ohio Miami County [seal] On the 20th day of September A D. 1836 before me John Webb a Justice of the peace within and for Said county personally Came Nancy Yates wife of Thomas J Yates the grantor named in the foregoing Deed of Conveyance and acknowledged the Signing and Sealing of the Same she having been examined Seperate and apart from her husband as the law directs and the Contents of Said Deed being to her fully made known and explained decalred that She had executed the Same freely and of her own good will without fear or Coercion of her husband Given under my hand and Seal the date above writen Entered the 4th October 1836 John Webb J.P. Recorded the 8th Oct 1836 Z. Riley Recd ------------------------------------ Compiler's note: Mary (Frazee) Yates was the mother of Thos. J. Yates and widow of Jonathan L. Yates, who died in 1830. The land described in this deed appears to be that which was willed to Mary by her late husband for use in her lifetime. [See will of Johnathan L. Yates, 1830] Thomas appears to be acting here on behalf of his mother, selling the land again just five days later to Jonathan Hammond. Thomas and his wife and children removed to IL ca. 1845. The Weatherhead family married into the Yates family; note that the two families land adjoined in Miami Co., as this deed shows.
