Courthouse, West Main St., Troy, OH 45373) Be it remembered that on the 23rd day of September 1868 the last will and testament of John Mumford dec'd was filed, proved and ordered to be recorded in the Probate Court of Miami County Ohio, gether with the testimony & c (?), which will, testimony & c is as follows to wit-- Know all men by these presents that I, John Mumford of Elizabeth Township Miami County State of Ohio. Considering the uncertainty of life, and being of sound mind, do make, declare and publish this my last will and testament. First, it is my will that all my funeral expenses and other just debts be paid. Second, I give and bequeath to my wife Mary Magdalena all my personal property, household and otherwise that I shall own at the time of my death. It is also my will that she live on and hold during her natural life time, or while she remain my widow, all the Real estate that I shall own at my death, situate in Miami County Ohio and that she and my daughters Mary J. and Sarah Amanda, have a comfortable living from the proceeds of said farm, while they remain single, or otherwise release all claims. I also desire and will that my sons John P. and Wm. R. Mumford, remain on, and cultivate the above said land. And after bearing all expenses and paying all taxes and after giving the above said support to my wife and daughters, said John P. and Wm. R. Mumford to divide the surplus between themselves. It is also my will that my Executor sell, and execute deed to all my real estate situate in Pike township Clark Co, Ohio and I will and bequeath to my grandson John G. Helvie five hundred dollars out of the proceeds of said sale which is to be his entire share of all my property said money to be held by my Executor until said John G. Helvie arrives at the age of twenty one years. The balance of said sale money to be divided equally between the following heirs, John P, Wm R, Joseph E, Mary J and Sarah Amanda. I desire that at the death of my wife, all the property remaining both personal and real estate be sold by my Executor and deeds made by him, after defraying all expenses, funeral or otherwise, that the money be divided equally between the above named heirs, and their heirs respectively. I do appoint Wm S. Mitchell to be the sole Ececutor of this my last will and testament. In testimony whereof I hereunto set my hand and seal this 22nd day of April one thousand eight hundred and sixty six. Signed, sealed, declared and published by the said John Mumford as and for his last will and testament in presence of us, who at his request and in his presence, and in presence of each other have subscribed our names as witnesses hereto. Mitchell, who being duly sworn depose and say that the paper before them purporting to be the last will and testament of John Mumford now deceased was by the said John Mumford acknowledged, published and declared to be his last will and testament in the presence of these deponents that the said deceased was of lawful age, that he was of sound and disposing mind and memory and under no restraint as they verify believe, that they subscribed the same as witnesses in the presence and at the request of the testator, and in the presence of each other.
