June 6/15 - Term expired - See pension case ------------------------------------------------------------ AFFIDAVIT of ALLEN WALLACE State of Ohio County of Morrow p on this 17th day of April one thousand eight hundred and sixty personally appeared before me a Justice of the Peace within and for the County and State aforesaid Allen Wallace aged sixty two years a resident of Peru Township in the State of Ohio who being duly sworn according to law declares that he is the identical Allen Wallace who enlisted in the service of the United States as a private. In the Company formed by Lieut McElvane in the war with great Brittian declared by the United States on the 18th day of June 1812 and was honorably Discharged on sixth day of June in the year of our Lord one thousand eight hundred & fifteen at Chillicothe in the State of Ohio and while in the service and in the line of his duty he received the following wound. The wound is on the left side of his head near the top of the crown of the head on the knight or morning of August 15th 1814. Can't state posatively what hour it was as I always supported and vainly believe was done with the But of a British Musket at the Battle of Fort Erie when the British was storming the fort when I came to my senses I found myself in the bomb proof of the fort and was afterwards informed by Lieut McElvane that he picked me up senseless and conveyed me to said bomb proof and have always been troubled with pane in my head and my left eye is and has been affected ever since can't see a single letter of print with said left eye. After I was discharged I remained in the State of Ohio in Franklin County until March 1816 then I went to Otsego Co. in the State of New York and staid there about three years then came into Cuyahoga Co. Ohio and staid about two years and then went to Erie Co, New York staid about two years and then back to Cuyahoga Co. O. again, one year in the State of Michigan and the balance of the time in this state and my occupation has been farming when able to do any thing not to exceed one half the time and not able to labor any. The informant further states that he is credibly informed and vainly believes that Lieut McElvan is dead and died some five years ago and he was the only officer of the Company that I know of and not one solitary soldier that I know of now living Allen Wallace State of Ohio County of Morrow P Personally appeared A. Pennock, residents of the town of Peru in said county, persons whom I certify to be respectable and entitled to credit and who being duly sworn say they were present & saw Allen Wallace sign his name to the foregoing declaration and they further swear that they have every reason to believe from the appearances of the applicant and those acquainted with him that he is the identical person he represents himself to be and the informants do reside in the town & County aforesaid A.E. Pennock Sworn to and subscribed before me this 17th day of April 1860 Solomon Westbrook, J.P. ------------------------------------------------------------ AFFIDAVIT of JOHN McELVAIN The State of Ohio Franklin County On this 29th day of August 1855 personally appeared before me J. P. Barrick, a Notary Public within and for the County and State aforesaid, John McElvain who after being duly sworn according to law, declared that he was a Lieutenant of the 19th Regiment of United States Infantry in the War of 1812, and that he was in the battle fought by the troops of the United States and in command of General Gains, and the troops of Great Britian under General Drummond at Fort Erie Upper Canada on the 15th of August 1814 and that a soldier of his command by the name of Allen Wallace of said Regiment also was also in said action and that during the rage of said battle was knocked down by a British soldier with a hand spike or with the breech end of a musket which blow he received near the crown of his head or rather over his left eye which blow has until this day left an indentation in his head and of course the skull bone must have been fractured, and that ever since he received said blow he has in some measure lost the sight of his left eye. Deponent further declares that after peace was declared, he discharged his Company (of the 19th Infantry) at Chillicothe in the State of Ohio, and that before he discharged it he invited every soldier belonging to it who had received any damage while in the service of the United States to come forward and be examined as to the degree of said damage, but said Wallace sayed he was too proud to ask a pension of the government, as long as he could live without it. Deposed further states that said Wallace was honorably discharged, and that he was a brave soldier in battle, and strictly obeyed every command of his officers, and that it is the opinion of the undersigned that he ought to have received a pension from the day he received the injury aforesaid. Owing to the length of time since the happening of the affair, deponent cannot remember every particular in regard to it, but at the same time believes the foregoing statement to be true in the man. Ohio ------------------------------------------------------------ AFFIDAVIT of CHESTER WALLACE Morrow County p on this 17th day of April one thousand eight hundred and sixty personally appeared before me a Justice of the Peace within and for the County & State aforesaid Chester Wallace aged sixty three years a resident of Peru Township in said county, being by me duly sworn says that he is well acquainted with Allen Wallace and has been acquainted with him all my life time or since he was born and that I have been informed by him and others that he enlisted in the regular army and I have often heard him complain of a pain in the left side of his head and his left eye and often heard him say he xxx a blow on his head with what he supposed a but of a musket at the Battle of Fort in August, 1814 and that he was sick at my house some four or five years after he left the army with a severe pain in his head and eye. The doctor xxxxxx xx performed some way on his eye and the phisican said he thought it proceded from the wound he xxx on the head. his occupation has been working on a farm what he has been able to do much and at present not able to do more than half days and his habits have always been temperate. WALLACE Morrow County p on this 17th day of April one thousand eight hundred and sixty personally appeared before me a Justice of the Peace within and for the County & State aforesaid George W. Wallace age thirty four years a resident of Peru Township in said county being by me duly sworn says that he is well acquainted with Allen Wallace and have been for over xxxx (looks like maybe twenty) years and I know of his having a would on the left side of his head and that he has nearly or entirely lost the use of his left eye and that he has not been able to labor not more than one half of said time in consequence of said wound and disease and now not able to labor. When he was able to labor worked at the farming business and that his habits are perfectly temperate and always have been so far as my acquaintance xxxxx. George W. Irvin, clerk ------------------------------------------------------------ AFFIDAVIT OF PENNOCK & LORD It is herby certified that Allen Wallace a Private in the Company of Lieutenant John McElvain in the nineteenth Regiment of the United States Infantry is rendered incapable of performing the duties of a soldier by reason of injuries said to have been inflicted while he was actually in the service aforesaid in the line of his duty as a Private. By satisfactory evidence & accurate examinations it appears that on the morning of the 15th of August 1814 being engaged in defending the Fort from the attack of the enemy at Fort Erie (near Buffalo) in the province of Canada. He received a blow (supposed from a musket) on the head fracturing & causing a permanent indentation of the skull on the upper posterior part of the left Parental bone. Said Allen Wallace since receiving this injury has been subject to spells of severe neuralgia of the injured & contiguous parts lasting at times two months without abatement & affecting his left eye in such a manner as to preclude the possibility of vision without severe pain. And he is thereby not only incapacitated for military duty. But in the opinions of the undersigned that he is one half disabled from obtaining his subsistence from manual labor. J. H. J.M.L. ------------------------------------------------------------ AFFIDAVIT of ZINA LLOYD Maple, Ionia Co., Michigan, April 15th 185 Enclosed you will receive the affidavit of Allen Wallace a neighbor of mine. He is a candid and sensible man although in needy circumstances & having a wife and five children dependant upon him for support & says he has never applied for a pension and I know of others who draw a pension and are not better entitled to one than this man. I now ask of you to present his affidavit at the Pension office and as I am not fully acquainted with the law upon the subject would ask of you the favor of ascertaining what further testimony this man needs to entitle him to a pension. Col. 19th Infantry ------------------------------------------------------------ PHEBE WALLACE WIDOW PENSION DECLARATION WAR OF 1812 DECLARATION OF A WIDOW FOR PENSION State of Illinois County of Knox On this 28th day of March A.D.one thousand eight hundred and seventy eight personally appeared before me Clerk the Circuit Court, of the County of Knox aforesaid, a court of record in and for the State aforesaid Phebe J. Wallace, aged 56 years a resident of Haw Creek Township, county of Knox State of Illinois, who being duly sworn according to law, declares that she is the widow of Allen Wallace, who served the full period of sixty days in the Military service of the United States in the War of 1812, and who was the identical Allen Wallace who enlisted in Captain Abner P. Penny, afterwards in John McIlvaines company, 19 regiment U.S. Inft at Worthington Ohio on the 18" day of March 1814 and was honorably discharged at Chillicothe Ohio , on the 5" or 6" day of June, 1815; that he enlisted under Capt. Penny, he being captured at Detroit at surrender of Genl Hull. Lt McIlvaine commanded the company, was sent to Franklintown Ohio, from there marched to Louisville, where he joined the Regt. Then marched to Cleveland & then to Erie, Pa. & on to Buffalo NY. On morning of Aug 14, crossed over to Ft. Erie Canada and helped to repel an attack of the enemy on that place. The enemy charged into the second co. Wallace received a strike over the head with a clubbed musket which wounded him severely from which by exposure afterwards he lost the sight of his left That she was married under the name Phebe J. Wallace to said Allen Wallace on the 24" day of September A. D. 1841, by Esq. Woodly at Columbia Ohio there being no legal barrier to such marriage; that her said husband died at Haw Creek Twp., Knox Co, Ill. On the 7" day of January 1863 and she has not remarried since his death; that at no time during the late rebellion against the authority of the United States, did she or her said husband adhere to the cause of the enemies of the Government, giving them aid or comfort, or exercised the functions of any office whatever under any authority, in hostility to the United States; and that she will support the Constitution of the United States; that she is not in receipt of a pension under any previous act; that she makes this declaration for the purpose of being placed on the pension rolls of the United States, under the provision of the act approved March, 1878 and hereby constitutes and appoints, with full power of substitution and revocation John le Stuart of Galesburg Ill., her true and lawful attorney....to prosecute her claim and obtain the pension certificates that may be issued; that her post office is at Eugene County of Knox State of Illinois; that her domicile or place of abode is Haw Creek Twp, Knox Co Illinois Phebe J. Wallace Applicant Attest Alice Winter xxxxxx ------------------------------------------------------------ AFFIDAVIT of PHEBE WALLACE State of Illinois Knox County Mrs. Phebe J. Wallace, Being first duly sworn on oath states she is an applicant for pension as the widow of Allen Wallace died, late a Private in the John McIlvaine's Co. 19" Regt. U.S. Inf. That she has no private record of her marriage, of having accidentally been destroyed some years ago and she further states that she thinks there is no public record of said marriage, but she can furnish the evidence of friends who knew thru prior to their removal to Illinois and also of friends since their arrival in the state, that they lived together as man & wife from the date of their reputed marriage. That there was no one present with whom she was acquainted at the time of her said marriage, they having gone to Esq. Woodley's house, he being a Justice of the Peace, and were there married. Mrs. Woodley & as I understood it the hired girl were called in as witnesses. I was not acquainted with any of these previous to going there and think I have not seen any of these since. She further says that she is the mother of his children. Eight of these are still living, or were a few weeks since when she last heard from those who are now living in Missouri. The youngest of these being 18 years of age this 2" day of July 1878. That upon their removal to Illinois they went to reside at the North East Quarter of Sec.1, Township 10 North of Range 3 East of the 4" Principal meridian, where she still resides, the above described land having been granted to her husband for his services in the War of 1812 Phebe J. Wallace Subscribed to and sworn before me this 28" day of March 1878 and I hereby certify that the affiant is a credible person & the person she represents herself to be. That she was made fully acquainted with the contents of the forgoing affidavit before signing. That she resides as stated. And that I am not interested. Farquer residents of Knox County after first being duly sworn depose and say that they were well acquainted with Allen Wallace dec"d and are also well acquainted with his wife, Phebe J. Wallace. That they became acquainted with them immediately after arrival is said county in the year 1861. Morgan Reece says he helped them build a house upon their farm soon after their arrival and Thomas B. Farquer lived upon their land for about five years and helped fence the place. They further say that the said Allen and Phebe J. Wallace lived together as man and wife from the time they became acquainted with them until his death in January 1863. And had a family of eight children living with them up to the time of their several marriages. And further that it is the general understanding among their neighbors that the land upon which the family resided was granted to said Allen Wallace for service in the U.S. service during the War of 1812. The said Phebe J. Wallace is still living upon said property. They further say they are not interested in her application for a pension Morgan Reece Thomas B. Com of Pensions Washington DC Sir Phebe J. Wallace who draws pension certificate no. 11742, War of 1812 died at this place Oct 3, 1896. There is no property to pay expense of sickness & burial.
