Columbus, Ohio 43201 coliver@netwalk.com September 13, 1996 *************************************************************************** Moses LUMAN - Will - Journal No 5 page 454 - Muskingum Co., Ohio --------- Probate Court Muskingum Couinty June 27th, 1870 In the matter of the Last Will and Testament of Moses Luman deceased This day the Last Will and Testament of Moses Luman late of Muskingum County Ohio was produced in writing in open court and duly proved by the Oaths of John P. Krier and Michael Fresh the two attesting and subscribing witnesses thereto, whosetestimony in behalf was reduced to writing and filed herein; and it appearing to the Court from said testimony that said Will was duly Executed and attested and that said testator Moses Luman, deceased, was at the time of the Exucition of said Will of full age, of sound mind and body and free from any restraint, it was by the Court ordered that said Will be and the said by admitted to Probate and that the same together with the testimony and this entry be duly recorded. ---- Will In the Name of the Benevolent father of all. I Moses Luman of the County of Muskingum, State of Oho do make and publish this, my last Will and testament. 1st I giv and devise to my beloved wife the house and land where the house is located so as to contain Sixty Acres, it to be stricken of so as to contain the house and the Out buildins, said land is situated in Harrison Township, Muskingum Co, Ohio and known as the home farm where I now Reside during her natural life and in lieu of her Dower interest in my Estate; Allso Tow hundred Dollars in money to be paid as soon as it is colected out of the assets of my personal Estate; and at the demise of my wife the land shall go as hereafter mention: 2nd I giv and devise to my son Asbury Luman Eleven hundred dollars in money 3rd I giv and device to my dauter Nurciss Carry, or if she should die before said money is paid her, then it shall go to her children Eleven hundred dollars in money. 4th I giv and device to my daughter Rebecca Bain, but if Rebaca Baom should die before said money is paid her, then if she has any children then it shall go to her children, if no children then Equally betwen my children the sum of Eleven hundred dollars in money. 5th I giv and device to my grandauter Maria Ann Luman two hundred dollars in money 6th I giv and device to my grand Son George Luman two hundred dollars in money. 7th I giv and device to my Gord daughter Nedda Luman two hundred dollars in money 8th I giv and device to my Son Henry Luman the homestead fram in fee simple containg about Eighty Acres more or less Except that portion that is bequeathe to my wife and after the death of my wife it shall all belong to my Son Henry Luman in fee simple. 9th I giv and device to my son John Luman the north part of my farm conaing about Eighty Acres more or less situated in Harrison Township, Muskingum County Ohio and ajoining on the East by lands owened by Jacob Eppley to him and his airs for Ever. 10th The money that I hav willed to my grandchildren must be put out on intrust in som safe investment, untill thay Respectifully becom of age; but if Either of my grand children should die before thay arive at age then the amount shall be Equaly be devided betwen the other two, and if two ot them shoud die before ariven of age then the two shears shall go to the one that survives. but if all theree should die before the amount of money is paid then it shall be Equaly betwen my children. 11th After my death my Executors shall sell all my personal property after appraisment at public Sale and give Shuch credit as he may trhink right and after the funeral Expencs are paid and the Expences of Adminstering my Estate and if any money is left it shall be Equally devided between Asbury Luman, Nursiss Carry, Rebeca Bain, Henry Luman John Luman. 12th I do hereby nominate and appoint Jacob T Bqllon Executor of this my last Will and testament, and to ajust Releace and discharge in Shuch manner as he may think proper the debts due me.
