Danford Be it remembered that heretofore to wit: On January 28, 1904, application for Probate of Will was filed herein which reads and is in words and figures following, to wit: application for Probate of Will – Probate court, Noble County, Ohio. In the matter of the Last Will and Testament of Ellis J. Danford, Deceased. To the Probate Court of said County, your petitioner respectfully represents that Ellis J. Danford late a resident of the township of Noble in said County, died on or about the 13th day of January A.D. 1904, leaving an instrument in writing herewith produced purporting to be his last will and Testament: That the said Ellis J. Danford died leaving Katie Danford his widow who resides near Belle Valley, Ohio and the following named persons his only next of kin, to wit: Name age of minors Degree of Kinship P.O. Address Robert Danford Son Belle Valley, Ohio Arza Danford Son Belle Valley, Ohio Mary Danford Daughter Belle Valley, Ohio Minnie Danford Daughter Byesville, Ohio Your petitioner offers aid Will for Probate and prays that a time may be fixed for the proving of the same, and that said above named persons resident in this state may be notified according to law of the pendency of said proceedings. Robert Danford, Petitioner And afterwards, to wit: On January 28, 1904, Will was filed herein which reads and is in words and figures following, to wit: The Last Will and Testament of Ellis J. Danford. In the name of the Benevolent Father of all, I the said Ellis J. Danford, being of sound and disposing mind and memory, considering the uncertainty of continuance in life, and desiring to make such disposition of my worldly estate as I deem best do make, publish and declare, this to be my last will and testament, hereby revoking and annulling any and all former will or wills whatsoever by me made. First: I desire all my just debts and funeral expenses to be paid, as soon as possible after my decease. Second: I give and bequeath and devise to my beloved wife Katie Danford, in lieu of her dower rights in all of my real estate, for and during her natural life only, provided she does not remarry, the following real-estate situate in the Township of Noble, County of Noble and State of Ohio to wit: Sixty seven acres off of the East side of the East half of the South east Quarter of section No. 15 in Township 7 of Range 9, the same being the farm upon which we now reside. In case my said wife does remarry or in case of her death, then and in that event it is my will that the above described real-estate be sold and the proceeds thereof divided amongst my children viz: Robert Danford, Arza Danford, Minnie Bond and Mary Danford, share and share alike. Third: I give, devise and bequeath all the rest and residue of my real-estate and any interest I may have therein to my children above named; and I hereby authorize and empower my executors hereinafter named, to sell the same for such price and upon such terms as they may think best and deeds to purchasers to execute in fee-simple, and divide the proceeds derived from such sales amongst my said children heretofore named, share and share alike. Fourth: It is my will that all my just debts and funeral expenses be paid out of my personal property and whatever is left of my said personal property after the payment of my said just debts and funeral expenses, I give and bequeath to my said beloved wife absolutely. Fifth: I nominate and appoint my two sons Robert Danford and Arza Danford executors of this my last will and testament.
