These electronic pages cannot be reproduced in any format for profit or other presentation. ================================================================== Thomas Rambo, Deceased At a court of Common Pleas begun and held at the court house in the town of Bellefontaine, within and for the county of Logan in the State of Ohio on the eleventh day of October Anno Domino One thousand eight hundred and forty eight, Present Hon. James L. Torbert Resident judge and Noah McCottech, William H. McKinnon and Peter Kelley associate judges, John Underwood, Jr. sheriff and Thomas M. Robb Clerk. The last Will and Testament of Thomas Rambo late of Logan County, deceased was this day brought before the court, and was proved by the oaths of Lot Garwood and David L. Garwood two of the subscribing witnesses thereto, whose examinations were reduced to writing, and it appearing to the satisfaction of the court that the said Thomas Rambo at the time of executing said will was of full age and sound mind and memory and not under any restraint, it is Ordered that said will and the proof so reduced to writing be recorded. And thereupon motion of William Rambo and Robert Mackey the executors in said will named, it is ordered that letters testamentary be granted to the said William Rambo and Robert Mackey who whereupon gave bond with John D. Nein and William G. Kennedy securities to the acceptance of the court in the penal sum of eight hundred dollars conditioned according to law: Whereupon it is ordered that Joseph Robb, Joseph McCormick and Lot Garwood appraise the personal property of said estate. And the will and proof so reduced to writing is now here recorded in the words and figures following, viz:- I THOMAS RAMBO of the county of Logan and State of Ohio do make and publish this my last will and testament in manner and form following that is to say. First. It is my will that my funeral expenses and all my just debts be fully paid. Second. I give, devise and bequeath to my beloved wife ELIZABETH RAMBO in lieu of her dower the plantation on which we now reside, situated in the county of Logan, containing about sixty three acres, during her natural life; also all the live stock, household furniture goods, chattels, monies, credits and effects; except so much as is herein otherwise disposed of. To have and to hold the same during her natural life and at her death, if there is any thing remaining to will it amongst my daughters and daughters children or any of them as she may think best. Third. As I have already given and made over in fee simple a farm or lot of land to each of my three elder sons WILLIAM RAMBO, DAVID RAMBO AND THOMAS RAMBO it is my will that they be therewith content and get no more. Fourth. I give and devise to my son JOHN RAMBO three fourths of the lot of land I now own in Harding County containing 200 acres to be divided east and west so that he may have the improved part to him the said JOHN RAMBO his heirs and assigns forever. Fifth. I give and devise to my son HAMILTON RAMBO the other fourth of the land in Harding County and at the death of my wife the farm on which we now reside to him the said HAMILTON RAMBO his heirs and assigns forever. Also my two sons JOHN RAMBO AND HAMILTON RAMBO are each of them to have the liberty of raising them a horse on the farm and get a saddle and such bed and bedding as their mother may think fit. Sixth. I will that my daughters RUTH MACKEY and NANCY SELDERS, and the heirs of my deceased daughters MARY ESTHER be satisfied with the portions already given them. Seventh. I will and devise to my daughter ELIZABETH RAMBO a horse saddle and Bridle, a bureau, table bed and bedding, a cow and heifer, five sheep and seventy dollars in cash to make her equal with the others. And lastly I hereby constitute my son WILLIAM RAMBO and ROBERT MACKEY to be the executors of this my last will and testament revoking and annulling all former wills by me made and ratifying this and no other. In Witness whereof I have hereunto set my hand and seal this 15th day of March eighteen hundred and forty three. Thomas Rambo. Garwood, witnesses to the last will and testament of Thomas Rambo deceased, who being first duly sworn, declare that the said Thomas Rambo at the time of making said will, was of full age, of sound mind and memory and not under any restraint; and that said will was duly executed in their presence and signed by them as witnesses at his request. The undersigned makes solemn oath that he will well and truly, honestly, and impartially appraise the estate and property that may be exhibited to me belonging to the estate of Thomas Rambo deceased, and perform the other duties required by law of me in the premises as one of the appraisers according to the best of my knowledge and ability. And thereupon came John G. Martini and John F. Lecklider, two of the subscribing witnesses to the said last will and testament and each in open Court on oath testified to the due execution and attestation of the said will; and their Testimony being reduced to writing was by the said witnesses subscribed, and the same has been attached to and filed with said last will and testament. And it appearing to the Court that such last will and testament was duly executed and attested, and that at the time of executing the same said Testator was of full age, of sound mind and memory, and not under any apparent restraint. Said last will and testament is hereby admitted to probate and the same together with this order, and the testimony of the said witnessed are hereby ordered to be recorded in the record of Wills of this Court, and the same is in the words and figures following, to wit: Will In the name of the Benevolent Father of all: I GEORGE RENTSCHLER, of Greenville, Darke County, Ohio do make and publish this my last will and testament It is my will that all my just debts and charges be paid out of my Estate. I give and bequeath to my beloved wife MARY RENTSCHLER four hundred dollars, that being the portion she brought with her at her marriage - I also give and devise to my beloved wife all of my property, personal and real which shall remain after paying my debts , to have and to hold during the full period of her natural life, or so long as she shall remain my widow; but if my wife shall again intermary [sic], then all of my property personal and real, except the foor [sic] hundred dollars aforesaid, shall descend to the heirs of her now invest in them and their heirs forever. I do hereby nominate and appoint MARY RENTSCHLER my wife, Executrix of this my last will and testament hereby authorizing and empowering her to compromise, adjust, release, and discharge in such manner as she my deem proper, the debts and claims due me - I do also authorize and empower her if she shall deem it necessary, or for the interest of the Estate, to sell by private sale, or in such manner upon such terms of credit or otherwise, as she may think proper, all or any part of my Real Estate, and deeds to purchasers to execute, acknowledge and deliver in fee simple. I also desire that no appraisement of my personal property be made; but that my Executrix sell my personal is [sic] she deems proper, and the the Coort [sic] of Probate, direct the omission of appraisement in pursuance of Statute. I do hereby nominate and appoint ly [sic] beloved wife Guardian of my sons WILLIE, GEORGE, and FRANK RENTSCHLER, and of my daughter MARY RENTSCHLER, until they shall respectively arrive at the age of majority; my said Guardian is hereby enjoined to give my children a good education and to rear them in habits of industry,and to care for them properly. I hereby revoke all former wills by me made. In testimony whereof I have hereunto set my hand and seal this 30th day of Dec. 1869. Lecklider two of the subscribing witnesses to the last will and testament of George Rentschler late of said County, deceased, who being duly sworn, depose and say that whey were present at the execution of the will, that they saw the Testator sign and heard him acknowledge the same as his last will and testament; and that at the time of executing the same said Testator was of full age, of sound mind and memory, and not under any apparent restraint, to their knowledge and belief.
