I John Price of the county of Belmont in the State of Ohio being weak in body but of sound and disposing mind, memory and understanding. Thanks be to Almighty God for the same, do make and publish this my last will and testament in manner and form following, that is to say. First, It is my will that my funeral expenses and all my just debts be fully paid. Second, I give desire and bequeath to my beloved wife besides the third by law allowed her, the use of my dwelling house during her natural life. Third, I give and desire to my youngest sons Francis and James, between them, the Plantation on which I now live, situated on Stillwater, Belmont County O. containing about two hundred and thirty acres and all the livestock, Horses, cattle, sheep, hogs, & etc. by me now owned, and to their heirs and assigns forever, they however in eighteen months from my decease pay to my other children Mary, John, Ann and Susannah the following sums hereinafter mentioned and bequeathed by me. Fourth, I give and desire to my daughter Mary Griffeth the sum of Five hundred dollars besides the amount I have already given her, and which I have her charged on my book to the amount of four hundred and twenty seven dollars & seventy five cents. Fifth, I give and desire to my son John the sum of Five hundred dollars besides the amount I have already given him and which I have him charged to the amount of Five hundred and twelve dollars & thirty four cents. Sixth, I give and desire to my Daughter Ann Todd the sum of Five hundred dollars besides what I have already given her, and which I have her charged to the amount of four hundred and twenty seven dollars & seventy five cents. Seventh, I give and desire to my daughter Susannah Ogelvee, the sum of Five hundred dollars, besides the amount I have already given her, and which I have her charged to the amount of four hundred thirty seven dollars and seventy five cents. Eighth, I will and bequeath also, that my executors pay after my decease to the support of the Gospel in the congregation of Stillwater, Oh (Presbyterian Church) ten dollars per year for ten years. Ninth, I hereby constitute and appoint John Duncan and my son Francis to be the executors of this my last will and testament, revoking and annulling all former wills by me made, and ratifying and confirming this and no other to be my last will and testament. David L Carrick (signature) John Duncan (signature) Entry of Probate The State of Ohio Belmont County ss: Court of Common Pleas of said county September Term AD 1844 This day was brought into court and presented for probate a paper writing purporting to be the last will and testament of John Price late of Belmont County deceased: and it appearing to the satisfaction of the court by the testimony of David L Carrick and John Duncan, the subscribing witnesses to said will, taken in open court reduced to writing and filed, that said will was duly attested and executed: that the testator at the time of executing the same was of sound mind and memory of full age and not under any restraint: where upon the court approve said will and order that the same with the proof now taken be recorded: The said John Duncan being named in the will of thedeceased as one of the Executors thereof declines taking upon himself the execution of the same before testifying as above: Thereupon on motion the court order that letters testamentary on the Estate of said deceased, issue to Francis Price the other Executor named in said will upon his giving bond with security in the sum of ten thousand dollars conditioned according to law: and John Chamberlin and James Price being offered are accepted as such security. The court appoint Henry Long, John Oglevee and John Moore appraisers of the Estate and property of said deceased. Evidence The State of Ohio Belmont County ss: Court of Common Pleas of said county September term 1844 David L Carrick and John Duncan the subscribing witnesses to a paper writing this day presented to said court for probate purporting to be the last will and testament of John Price late of said County of Belmont deceased came into court and each being solemnly sworn in open court the said David L Carrick for himself upon his solemn oath saith that he saw the testator sign said paper writing as and for his last will and testament tha he subscribed the same as a witness thereto in the presence of the testator and at his request: that the testator at the time of signing said will was of sound mind & memory twenty one years of age and not under any restraint. Carrick (signature) And the said John Duncan for himself upon his solemn oath saith that he saw the testator sign said will, that he subscribed the same as a witness thereto in the presence of the testator and at his request: that the said testator at the time of signing said will was of sound mind and memory, twenty one years of age and not under any restraint John Duncan (signature) Taken reduced to writing and subscribed in open court this 9th day of Sept AD 1844.
