Nicholas was the son of Absolom W. Nicholas and Mary Ann Schaeffer, and the grandson of Abraham Nicholas and Mary Westfall. JOSEPH LAWRENCE NICHOLAS Will In the matter of the Last Will of Joseph L. Nicholas, Deceased. Probate Court, Montgomery County, O; Dayton O. March 13, A.D., 1888 This day an instrument of writing, purporting to be the Last Will and Testament of Joseph L. Nicholas, late of Jefferson Township, in this County, deceased, was produced in open Court for Probate. It is now ordered that the said Will be filed in this Court, and that due notice thereof and of the application to admit the same to Probate and Record, be given to the next of kin of the Testator, resident of the State of Ohio, two days prior thereto, that said application will be for hearing before this Court, on the 19th day of March A.D. 1888, at 2 o'clock P.M. Wm. D. McKenny, Probate Judge And afterwards, to wit: on the 19th day of March A.D. 1888, the findings and orders of this Court, relative to the Last Will and Testament of Joseph L. Nicholas, deceased, were entered on the Journal in words and figures following, to wit: Be it remembered that, heretofore, to wit: on the 13th day of March, A.D., 1888, an instrument of writing, purporting to be the Last Will and Testament of Joseph L. Nicholas late of Jefferson Township, in this County, deceased, was produced in open Court for Probate, ad was then filed. And it now being shown to the satisfaction of the Court, that due notice of the filing of said Will and of the application to admit the same to Probate and Record in this Court, has been given to the widow and next of kin of the testator, pursuant to a former order of this Court,; thereupon on this day came N. N. Prugh, Abraham R. Nicholas, and Wilson E. Shank, the subscribing witnesses to said Will, who being duly qualified to the due execution and attestation of said Will; which testimony was reduced to writing, by them respectively subscribed and filed with said Will. Whereupon, the Court finds that the aforesaid instrument of writing is the Last Will and Testament of said Joseph L. Nicholas, deceased; that the same was duly executed and attested; that the said Testator, at the time of signing the same, was of lawful age, of sound and disposing mind and memory, and under no undue or unlawful restraint whatsoever. It is, therefore, by the Court ordered, that the said Will be admitted to Probate, and that the same, together with the testimony of the witnesses above named, be entered of Record in this Court. Wm. D. McKenny, Probate Judge Know all men by these Presents: That Joseph Lawrence Nicholas being of sound and disposing mind and memory do declare this my last will and testament. Item 1: I give, devise, and bequeath to my beloved wife (Sebethina?) J. Nicholas all my goods, chattels, or real estate of which I may die possessed, absolutely and in fee simple to hold to her, her heirs and assigns forever, she paying all debts and charges against my estate. Item 2: I direct that no inventory nor sale be made of my said estate. It is reached by a ford across Russell's Fork. The earliest grave noted was 1821 but there may be some earlier. This record is not complete. Transcribed April 1, 1961 by T.H. Smith. Coan who was son of Asa and Mary Coan, is believed to have been the daughter of Harvey and Abigail Hall. ***These are buried on the same lot as John and Sabra Jones and the Coan children and are undoubtedly grandchildren of John and Sabra. John Wikoff married Nancy Jones, born Kentucky about 1803; Milton Jones born in Kentucky about 1805; Mary (Jones) Coan born Gallitin Co., Ky., August 9, 1800.
