It is my will that my funeral expenses and all of my just debts be paid. 2nd. I give, devise, and bequeath to my beloved wife Sarah Nicholas all of my property both real and personal, money and credits and effects whatsoever, for her use, benefit, and enjoyment, during her natural life. And upon the death of my said Wife, all of my property that remains unconsumed by her, to be equally divided among all of my children, no appraisement of my personal property required. I hereby appoint my said Wife Executor of this, my last Will and Testament. No bond required of said Executrix. I hereby revoke all former Wills by me made. John Karch Henry Overholser Afterward and to wit; on the 22nd day of March, A.D., 1878, personally appeared in open court, John Karch and Henry Overholser, the subscribing witnesses to the last Will and Testament of William Nicholas, deceased, who being duly sworn according to law, to speak the truth, the whole truth, and nothing but the truth, in relation to the execution of said Will, depose and say that the paper before them, purporting to be the last Will and Testament of William Nicholas, deceased, is the will of said deceased, that they were present at the making of said Will, and at the request of the Testator subscribed their names to the same as witnesses in his presence and in the presence of each other; that they saw the said William Nicholas, deceased, sign and seal said Will, and heard him acknowledge the same to be his last Will and Testament; that they said William Nicholas at the time of making, signing, and sealing said Will, was of legal age and of sound and disposing mind and memory and under no unlawful restraint whatsoever, as they verily believe. This day the last Will and Testament of William Nicholas deceased was presented in this Court for Probate and the testimony of John Karch and Henry Overholser, the subscribing witnesses to said last Will and Testament, was in open court taken and reduced to writing, and the Court being satisfied from said testimony, that the said William Nicholas, deceased, at the time he executed said last Will and Testament, was of legal age and of sound and disposing mind and memory and under no undue or unlawful restraint whatsoever. It is therefore by the Court ordered that said last Will and Testament be, and the same is hereby admitted and with said testimony ordered to be recorded. Sarah Nicholas, widow, after having her rights under the Will and under the law explained to her by the Court she elected to take under the law. Sarah Nicholas, Executrix, named in said Will, in open Court declined to accept said trust. Therefore, William Nicholas made application to be appointed Administrator with the will annexed. Sworn statement filed. William Nicholas approved Administrator with the will annexed of the estate of William Nicholas, deceased, late of Montgomery County, Ohio. Bond filed in the sum of $1800.00 with Jacob Poke and Andrew J. Nicholas, sureties, approved.
