Jacob Crotinger's Will The State of Ohio: Knox County (?): Be it remembered that at a court of Common Pleas holden before the Hon. Ezra Dean President Judge of the court of Common Pleas __ and __ Abner __ and James Elliot two of the associate judges of said court on the seventh day of March A. D. one thousand eight hundred and thirty six.... the last will and testament of Jacob Crotinger deceased was produced in court and James Low and William Bevans the subscribing witnesses thereto being in open court, duly sworn and interrogated depose and say that they saw the said deceased sign the said will and heard him acknowledge the same to be his last will and testament, and that in the presence and by the express direction of the testator they signed the same as witnesses and the said witnesses being further interrogated state that the said testator at the time of signing the said will was of sound mind and memory of full age, and not under any restraint to the best of their belief. Whereupon it appearing to the court that said will was duly executed it is ordered that letters testamentary issue to Henry Crotinger the executor in said will named upon his entering into Bond in the sum of six thousand dollars with Thomas Irvine and William Bevans who are approved of as Bail. It is further ordered that the Clerk record said will, and the proof above taken, thereupon the said Henry Crotinger appeared in open court and was duly sworn agreeably to law; and it is ordered that William Welsh, Benjamin Kellar and Joseph Gosnell appraise the personal estate of said deceased; which said will made in the words and figures following trial: "in the name of God, Amen, I Jacob Crotinger of Clinton Township, Knox County Ohio, being weak in body, but sound of mind and memory do hereby ordain, declare and establish this my last will and testament in form and manner following that is to say - first - I will and bequeath to my beloved wife Mary during her widowhood the use and possession of my farm on which I now live together with all that personal property by me owned conditioned that she cause to be paid any and all debts that may be due and owing to any person by me, and also the expenses which may accrue in my burial, all of which she is to have and to use for her support during the time before mentioned; - and I further will and declare after the decease or close of the widowhood of my wife then all the personal property by her left shall be sold in the usual manner of selling the personal property of deceased persons, and also the farm, and after defraying the debts if any that she may be owing, and also the expenses of her last sickness, and her funeral expenses, the amount that may be left shall be divided amongst my children or their heirs as follows: That is to say to each an equal share with this exception, that my daughter Christina shall receive the sum of two hundred dollars first, and shall in addition thereto receive her equal share with the rest of my living __: Elizabeth Simpson, Henry Crotinger, Catherine Krigley, Wm. Cole and Jacob Cole the children and heirs of Mary Cole decd., Margaret Hazen, Sarah Crider, and Christina Crotinger, each of whom are to receive equal shares, subject to the provisions in favor of Christina and counting Jacob and William Cole as one share and to be paid as follows: the first monies __ after ascertaining the whole amount, to be paid to the oldest heir, living, and so on to the youngest, provided that the share due Jacob and Wm. Cole shall be put on interest should they not have arrived at twenty one years of age when the money shall have been collected, and when they shall arrive at twenty one, they are each upon coming to such age to receive his share, together with the interest which may have accrued thereon, provided also that the two hundred dollars before mentioned which is to be paid to my daughter Christina shall be the first monies paid and then begin at the eldest and progress to the youngest as above stated; and for the purpose of carrying into effect this my last will and testament according to the true meaning and interest thereof I do hereby constitute and appoint my son Henry Crotinger as my executor with full faith and confidence that he will cause the same to be strictly executed agreeably to the manner and from herein prescribed; In testimony whereof I hereunto set my name and seal this first day of December in the year of our Lord one thousand eight hundred and thirty five, (signed) Jacob Crotinger (his mark) (seal).
