Terrence, President Judge of the ninth judicial circuit of the State of Ohio Willander Anderson, James Finley and Robert Breckenridge associate Judges of the Court of Common Pleas in and for the County aforesaid on the second day of August in the year of our Lord one thousand eight hundred and thirty. This day the last will and testament of William Gates deceased was again produced in open court and further proven by the oath of William Hall one of the subscribing witnesses thereto which was ordered to be recorded together with the proof thereof which said will is in the words following to wit. I William Gates being of sound mind and memory do hereby make and ordain this my last will and testament in the words and manner following to wit - I leave and bequeath to my loving wife Sarah all my property real and personal of every kind and description without exception to be by her held used and disposed of as she shall think proper during the time of her natural life as also the full power to dispose of the same by will at her death as she shall see proper but in case the said Sarah shall marry again then she is to retain nothing but what the law allows her and the balance shall be equally divided between my son Allen and my daughter Mary Gray and my daughter Lilina Drey. In testimony whereof I have hereto set my hand and affixed my seal this twenty sixth day of October in the year of our Lord one thousand eight hundred and twenty nine. Personally appeared in open Court Eli Davidson being duly sworn according to law deposeth and saith that he is a subscribing witness to the paper here produced purporting to be the last will and testament of Will Gates that he was present and heard him acknowledge the same to be his last will and testament that he signed the same as subscribing witness at his request in his presence, and in the presence of William Hall another witness believes the said William Gates was of sound mind, memory and judgment at the time of executing said will that he was more than twenty one years old, and under no legal restraint at the time of executing the same. Personally appeared in open Court William Hall who being duly affirmed according to law saith that he is a subscribing witness to the paper here produced purporting to be the last will and testament of William Gates that he was present and heard him acknowledge the same to be his last will and testament that he signed the same as subscribing witness at his request and in his presence and in the presence of the other witness to said will that he believes the said William Gates was of sound mind memory and judgment at the time of doing the same that he was more than twenty one years of age that he was under no legal restraint.
