I George Wurth of the City of Cincinnati, County of Hamilton and State of Ohio, being of lawful age and of a sound and disposing mind and memory, and under no restraint whatever, do make and publish this my last will and testament. Item I It is my will that all of my just debts and charges be first duly paid out of my estate. Item II I give and devise unto my beloved wife Therisia Wurth in lieu of her dower and first years subpart All of the balance of all my property, Real, Personal and Mixed, of whatever kind and nature the same may be of which I may be possessed at the time of my deceased during her natural life. Item III After the deceased of my said wife the property then unconsumed by her I give and devise unto my children as herein after stated, share and share a like as follows. I am the owner in fee of Lot Number twenty-five of Findl(a)ys & Garrards subdivision as recorded in Book 47 page 319 Hamilton County Records and described in a deed to me ...Book 101 page 293 of the same records. Said lot with the Improvement thereon I have caused to be surveyed and subdivided by R. C. Phillips Esq. August 7 1868 and plotted and markt as Lots No. 1, 2 & 3 as follows (then follows a sketch of the lots). Reference is hereby had to the plat made by said Phillips of which the above is a copy. The entrance or gangway between No 2 & 3 shal remain as now (frontin on Vine Street)as long as both buildings stand. Said real estate to go to my children as follows, vis (a)To my daughter Maria Volz, late Wurth, all of lot number one being the corner of Vine & Findlay Streets, as shown on the above plat during her natural life and after her decease to the children of her body share and share alike forever. (b)To my daughter Therisia Wurth all of lot number two, as above markt, being next south of Maria's lot, forever. (c)To my daughter Rosia Jacob, late Wurth, all of lot number three adjoining the alley forever. Subject to the payment of said Rosia to Maria and Therisia of the following sums of money, To Therisia Wurth one hundred and fifty-six dollars, payable with interest one year after the decease of my said wife or in case I survive her in one year after my deceased. To my daughter Maria Volz the sum of three thousand six hundred eight-six dollars to be paid to her use in two equal yearly payments vis in one and two years after the deceased of my said wife or in case I survive her after my deceased with interest. Said money during the lifetime of my said daughter Maria shall be reinvested upon mortgage or expended for the purpose of building on her lot corner of Findlay and Bremen Street, as named above, the income either as rent or interest shall be paid to her during my life and after deceased the same shall go to her children in the same manner as the real estate forever. My said daughter Maria shall after the decease of my said wife elect a trustee other than her husband to whom said moneys shall be paid by my said daughter Rosia who is hereby authorized to invest the same as mortgage, or build such addition as my said daughter Maria may desire, in no event is her present husband to have any control or handling of said money, and the receipt of said trustee together with my said daughter shall be a sufficient and final discharge to Rosia for any payment to made. Item IV I do hereby nominate and appoint my said wife Executrix of this my last will and testament and request that no security be required of her. Should there be any money or bank bills at the time of my deceased the same shall be the property of my said wife absolutley. I do hereby revoke all former wills by me made.
