I, Farnum Hardy, of the County of Meigs & State of Ohio, being sick & weak in body, but of sound mind, memory & understanding (praised be God for it)& considering the certainty of death & the uncertainty of the time thereof; & to the end I may be the better prepared to leave this world when it shall please God to call me hence do therefore make & declare this my last will & testament, to wit. I will that my just debts & funeral expenses be paid out of my personal estate a soon as may be after my decease. I give & bequeath to my brother Merrill Hardy and my sister Eliza Hardy one dollar each. I do give & bequeath to my brothers Otis Hardy & Russel Hardy all my real estate, to wit, the land deeded to me by Josiah Curtis being a part of Fraction twenty four in Sections twenty seven & twenty eight Town three & Range twelve & also the lot of land I hold by lease from the Trustees of original surveyed Township number three it being a part of Section sixteen in Range twelve, appropriated for the use of schools to have, hold, occupy & share the same in the following manner that is to say-It is my desire & will that my brother Russel Hardy Occupy & farm the premises willed as above during his minority under the direction of my brother Otis, to whom I entrust the care & management of the whole until Russell shall arrive to the age of twenty one years. It is then my will & desire that the said Russell if then living do make his election what part he will take for his share & that if he shall choose the leasehold property above described Otis to have the said real estate, but if he shall choose the real estate Otis to have the leasehold & that when he shall have made his election the the said Otis & the said Merrill do each quit claim to the other for their respective portions and the said premises are will & bequeathed to the said Otis for the purpose & in consideration that he shall provide for & maintain my mother Sarah Hardy in a suitable manner so long as she shall live. He shall provide & furnish a home for my Sisters Thuriza & Emily so long as they shall remain single wherever they may choose to reside on the premises so willed to him the said Otis as aforesaid. I give & bequeath to my brothers Otis Hardy & Russel Hardy the residue of my personal estate after my just debts, funeral charge & legacies are paid, share & share alike. And I do hereby nominate & appoint my brother Otis Hardy Executor of this my last Will & Testament hereby revoking all former & other Wills & Testaments by me made heretofore. That I Sarah Hardy widow of the said Wyman Hardy now deceased & we Farnum Hardy Thirza Hardy Eliza Hardy Emily Hardy & Otis Hardy Russel Hardy being heirs at law of the said Wyman Hardy all of the township of Chester County of Meigs and State of Ohio for and in consideration of Josiah Curtis to our full satisfaction the receipt whereof is hereby acknowledged and ourselves therewith contented have given granted bargained sold ___ released and forever quit claimed and by these presents do give grant bargain sell __ release and forever quit claimed unto him the said Josiah Curtis his heirs and assigns forever a certain tract or parcel of land situated in the township of Chester aforsaid described as follows to wit forty six acres off from the South West corner of the North East Quarter of Section Number sixteen (No.16) in Township number three (No.3) Range twelve (No.12) in the Ohio Company Purchase Beginning at a post in the center of said section of Southwest Corner of said Quarter Section and running from thence North one hundred and twenty ___ to a post thence East sixty one and three tenths perches to a Post in Farnum Hardy improvements thence south one hundred & twenty (120) perches to a birch tree thence West sixty one three tenths perches to beginning containing (46) forty six acres be the same more or less to have and to hold the said premises together with all and singular the privileges and appurtenances thereunto belonging or in any wise appertaining to him the said Josiah Curtis to him for and during the remainder of the term of thirty nine years from the twenty fifth day of June A.D. 1822 agreeably to the ____ and effect of the lease above described in as ample a manner as the said Wyman Hardy deceased did hold or could have held the same under and by virtue of the lease aforesaid or as we the undersigned widow and heirs at law of the said Wyman Hardy now hold the same.
