At a court of common pleas begun and held at St. Clairsville in and for the county of Belmont on the third day of November in the year of our Lord one thousand eight hundred and twenty three before the Honorable Jeremiah H. Hatlock President and Edward Brysen, John Wiley, And Alexander Armstrong associate Judges of said Court..Was brought into court the last will and testament of John Edwards late of Belmont County deceased by the Executors therein named and was proved and established by the oaths of Henry Long and Thomas Dunn, two subscribing witnesses thereto and ordered to be recorded. And hereupon the court order that letters testamentary issue to James Edwards and John Edwards the executors named in said last will and testament and the court do appoint James Milllison, Bzil Ridgeway and Robert Armstrong appraisers to appraise the personal property of said deceased. Whereas John Edwards late of Belmont County deceased, died leaving a last Will and Testament (a copy of which is hereunder written) Whereas now the same John Edwards and James Edwards are appointed Executors thereof and the said last will and testament being duly proved in and approved of by the court. I Ezer Ellis clerk as aforesaid do by these presents by order of said court commit unto you full power and authority over all and singular the goods and chattels, rights & credits, monies & effects of the said deceased well and faithfully to dispose of the same according to the said last will and testament as also to ask, gather, receive & recover all and every debt and credit whatsoever of the said deceased which to him whilst he lived and at the time of his death did appertain. You are also to pay and discharge all & singular the debts dues and demands which ! the said decreased at the time of his death (including his funeral expences) stood bound to pay according to the laws of this State so far a s the goods & chattels, rights & credits, monies & effects come to your hands will extend and for that purpose you are to call on each creditor of the deceased by public advertisement to exhibit to you their several lawful within one year from this date. You are also to make out a true and perfect Inventory of all and singular the goods & chattels of the said deceased and have the same appraised by James Millison, Bazel Ridgeway and Robert Armstrong appraisers appointed by the court and exhibit the same together with a correct list of the rights & credits, monies & effects of the said deceased to the said court at the next term. And you ar to make out and tender to said Court a true and accurate account of your administration within one year from the date unless further time is granted by the court for that purpose. I John Edward of Belmont County Kirkwood Township and state of Ohio - being weak in body but of sound and perfect mind and memory blessed by Almighty God for the same, do make and publish this my last Will and testament in manner and form following: that is to say: First, I give and bequeath to my beloved wife Ealinor Edwards one mare colt rising two years old and cow named young lovely the walnut table now in the house and I likewise give and bequeath to my beloved wife one third of the income or prophets of my real estate during her natural life; I also give and bequeath to my youngest son James Edwards my mills and all the lot of land it and my buildings stand on him to have and to hold the same during his natural life; It is my will and pleasure that after the death of the said James Edwards that it is my will and pleasure that all the property bequeathed to the above James Edwards that it is given to and thereby give and bequeath the same to h! is son John Edwards him and his heirs to have and to hold forever; I likewise give and bequeath to my daughter Elizabeth Price one cow; it is further my will and pleasure that my son James Edwards pay to my daughter Mary Lappings five dollars in six years after my decease; it is also my will and pleasure that my said son James Edwards pay to my son Jhn Edwards ten dollars in six years after my decease; and lastly, as to all the residue and remainder of my personal estate goods and chattels of what kind soever I give and bequeath to my son James Edwards, whome I hereby together with my son John Edwards do appoint my Executors of this my last will and testament, I witness whereof I have hereunto set my hand and seal the twenty sixth day of January in the year of our Lord one thousand eight hundred and fifteen. Item 1st I hereby will and bequeath to my son Thomas Edwards the sum of two hundred dollars. Item 2nd I will and bequeath to my daughter Rebecca the sum of two hundred and twenty five dollars. Item 3rd I will and bequeath all my personal moveable property to my daughter Rebecca. Item 4th I will and bequeath to my daughters Elizabeth Daniels, and Rachel Ott, the sum of twenty five cents each. In testimony of which I herewith set my hadn and seal this 22nd day of Nov 1856. Carmen a justice of the peace of said county and state Prudence Edwards and acknowledged the above to be her voluntary act. Nov 22 1856. W.C. Carmen, J.P. Probate The State of Ohio Belmont County - Probate Court Augt. 27 1859. The last will and testament of Prudence Edwards late of Belmont County Ohio deceased, was this day brought into the Probate Court of Belmont County and presented for probate, and it appearing to the satisfaction of the County by the testimony of William C. Carmen and John P. Brewer the subscribing witnesses to said will this day taken in open court recorded in writing and filed, that said will was duly attested and executed, that the testatrix at the time of executing the same was of sound mind and memory of full age and not under any restraint, Thereupon the court approved said will, and order that the same be recorded with the proof since taken to prove the same. Robert Clancy, Probate Judge Evidence The State of Ohio Belmont County,. On the 27th day of August 1859 appeared before the Judge of the Probate Court of said County, W. C. Carman and John P. Brewer the subscribing witnesses to a paper writing this day presented to said Court for probate, purporting to be the last will and testament of Prudence Edwards late of said county, deceased, came into court and each being solemnly sworn and affirmed in open Court. The said W.C. Carman for himself upon his solemn oath said that he saw the testatrix sign the said paper writing as and for her last will and testament, that he subscribed the same as witness thereto in the presence of the testatrix and at her request, that the testatrix at the time of signing was of sound mind and memory, twenty one years of age, and not under any restraint. W.C. Carman The said John P. Brewer for himself upon his solemn oath .. Saith that he saw the testatrix sign said will, that ... the same and was witness thereto in the presence of the testatrix and at her request; that the said testatrix at the time of signing said will was of sound mind and memory, twenty one years of age, and not under any restraint. J.P. Brewer ... to writing and subscribed in open court at my office in St. Clairsville, this 29th day of August AD 1859. Attest Robert Clancy, Probate Judge. Belmont County Judge of the Probate Court in and for the County of Belmont Ohio do hereby certify the foregoing to be a complete record of the will of Prudence Edwards deceased, with the entry of the probate thereof, and the testimony of witnesses to prove the same.
