All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/oh/ohfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Barbara Allen ballen@lgsd.k12.ca.us July 21, 2007, 9:21 pm Source: Perry County, Clerk Of Courts, Minutes "probate" Written: April 24, 1837 Perry County, Clerk of Courts, Minutes "Probate" October Term- 3 Nov. 1837 The last will and testament of Jacob Martin late of Perry County deceased was produced in court and proven by the oats of William Coffman and Hezekiah Franklin subscribing witnessness to the same who upon their several oaths do testify that they were present at the execution of said will and testament by the deceased and saw him sign the same that he requested of each of them to witness the same that they and each of them signed the same as such witness in his presence and the present of each other that they and each of them believed the deceasent to have been at he time of signing as foresaid of sound and disposing mind and memory of can full age and under no restraint and that the deceant at the same time declared the same to be his last will and testament. The to said will and testament by the agreement of the parties to the same is hereby abandoned and to be considered as null and void the temporary abilities of adm. hereto granted in his behalf to George Martin are hereby revoked and the ocud George Martin Executor named in said will being in court was --- to give bond and security for the performance of his duty as such executor with George Hamit and William Martin in the sum of sixteen hundred dollars and having intent into said bond -- George was qualified as executor of foresaid and letter testimony granted him and said will and proff ordered to be recorded. Will: written April 24, 1837 I Jacob Martin of the county of Perry in the State of Ohio, do make and publish this my last will and testament in manner and form following that is to say: First it is my will that my funeral expenses and all my just Debts be fully paid. 2ly I will that my Real Estate amounting to 89 acres of land be the same more or less be sold to the highest bidder at public sale and the money arising from such sale I will to be equally divided among my lawful heirs, thirdly I will and bequeath to my beloved son George, all that is due me on three notes amounting to two hundred and twenty seven dollars and 50 cents principal with all interest thereon as compensation for taking care of me. fourthly I will that all my personal property be sold and all moneys arising there from after the payment of my first debts be equally divided amongst my just heirs. And lastly I hereby constitute and appoint my son George Martin to be the Executor for this my last will and testament revoking and annulling this and no other to be my last will and testament. In Testimony whereof I have hereunto set any hand and seal this twentyfourth day of April A. D. 1837; signed and published and declared by the above named Jacob Martin as and for his last will and testimony in presents of us who at his request have signed as witnesses to the same. William Coffman Jacob Martin Hezekiah Franklin Whereas I Jacob Martin of Perry County having duly executed my last will and testament, in writing bearing date the 24th of April A. D. 1837, Now I do hereby declare this present writing to be as codicil to my said will, send direct the same to be amended there to, and taken as part there of and I do hereby give and bequeath unto my beloved Son George Martin all the Land I now hold lying on the north side of Kents Tein and side on which said G. Martin's mill is on supposed to contain Eight Acres be the same more or less, being part of the North East quarter of Section No. 3 Range 15 Township 17 I do hereby move so much of the 2 article of my will as in inconsistent and combra to this ordered in witness whereof I have set my hand May 3, 1837. Jacob Martin signed sealed and published by the said Jacob Martin of Perry County as an for a codicil to be added to and be considered as a part of his last will and testament in the presents of us who have subscribed our names in his presents. Hezekiah Franklin Rowland Shiplet In agreement now in between George Martin of county of Perry and State of Ohio of the our part and William Martin and Abram Martin of the same county, John Martin of Muskingum county of said state, Jacob Martin of the State of Maryland of the other part. Witnesseth-- That whereas the parties being all sons heirs at law obligatus of Jacob Martin late of said Perry county in Ohio deceased, who died having a will and codicil which now presented to the court of Common Pleas of said Perry County at the July Term 1837 thereof for probate-- I which was contested and the final probate thereof continues and now this agreement further witnesseth that the said parties have mutually agreed and consented that said will shall be admitted to probate and stand as the last will and testament of this said deceased Father Jacob Martin-- but that the said codicil accompanying said will shall be let abided and held for naught and that no ligation names therein shall take any thing hereby , and that the said George Martin shall content himself by the bequests made in said will and shall not claim or be allowed any lump of money or other thing out of the estate of the said decedent for any charge whatsoever to be presented by said George against said estate other than is allowed him by said will other said John also agrees to bring no charge against said estate dated 3 Nov 1837 witness as to the 3 first signatures: J.
