January the 23rd 1858. Be it remembered that on this day the last Will and Testament of Dorcas Gardiner late of Pike County, State aforesaid deceased was produced in open court and proved by the oaths of A. Brubaker and Amaziah Penn the subscribing witnesses thereto whose examination was reduced to writing and together with said Will was ordered to be recorded and which said Will and proof are in the words and figures following to wit: In the name of the benevolent Father of all: I Dorcas Gardiner of the County of Pike and state of Ohio do make and publish this my last Will and Testament. Item 1st I devise and bequeath to my brother Isaac W. Gardiner and his heirs my interest in the farm on which the said Isaac W. Gardiner now lives and occupies being sixty acres, being part of the farm of Thomas Gardiner Dec'd. Entry No. 2975 situate in the County of Pike and State aforesaid and on the waters of Morgan's Fork of Sunfish to have and to hold forever. Item 2nd I devise and bequeath to my beloved Brother Thomas Gardiner one Double Comforter valued by me at Ten Dollars. Item 3rd I devise will and bequeath to Thomas G. Parker my sister Nancy Parker's heir, one calico quilt valued by me at Five Dollars. Item 4th I give devise will and bequeath to Lydia Leath, my sister Nancy Parker's heir, one calico quilt valued by me at Five Dollars. Item 5th I give devise will and bequeath to Samuel Parker, my sister Nancy's heir One Dollar to be paid out of my personal property. The above being the proportion that I bequeath to my deceased sister Nancy Parker's heirs. Item 6th I give devise, will and bequeath to Erlinda Thomas Deceased Two Dollars to be divided among her heirs. Item 7th I give devise will and bequeath all the balance of my personal property after my funeral expenses are paid to my beloved brother Isaac W. Gardiner. Item 8th I do hereby nominate and appoint my beloved brother Isaac W. Gardiner executor of this my last Will and Testament hereby authorizing and empowering him to compromise adjust release and discharge in such manner as he may deem proper the debts and claims due me. I do also authorize and empower him if it shall become necessary in order to pay my debts to sell by private sale or in such manner upon such terms of credit or otherwise as he may think proper all or any part of real estate and deeds to purchase to execute, acknowledge and deliver in fee simple. I desire that no appraisement and no sale of my personal property be made and to Court of Probate direct the omission of the same in pursuance of the statute. In the testimony here of I have hereunto set my hand and seal this 30th day of July A. D. 1857 Signed and acknowledged by said Dorcas Gardiner as her last Will and Testament in our presence and signed by us in her presence. Dorcas (her x mark) Gardiner {seal} A. Brubaker Amaziah Penn The State of Ohio Pike County on the 23rd day of January A. D. 1858 personally appeared before me E. R. Allen Deputy Clerk of the Probate Court within and for the county of Pike and state aforesaid A. Brubaker and Amaziah Penn who being duly sworn according to law deposith and saith that they have now and seen and inspected the paper writing produced as and for the last Will and Testament of Dorcas Gardiner late of Pike County Ohio Dec'd, that they are the attesting witnesses to said will. That said Dorcas Gardiner at the time of executing said Will was of full age, of sound mind and memory and was not under any restraint at the time of executing the same. That said paper writing was for her last Will and Testament. That we attested and subscribed the same in presence of said Dorcas Gardiner at her request and that the same was acknowledged by her as her last Will and that we subscribed the same in presence of each other. Additional Comments: Erlinda (Arlinda)Thomas listed in the will, Dorcas' deceased sister, was my ancestor who married Abraham Thomas 7 Jun 1810 in Ross County, OH. Dorcas was the daughter of Thomas Gardiner and Elizabeth Downing married 15 Dec 1787 in Bourbon, KY. Dorcas never married. In the 1850 Pike, OH census, living with her brother Isaac Wells Gardiner, was listed as deaf in the census.
