Brooke Exr 2312 1, 449 They have gotten out the original will which seems to be written by Mr Finley himself on all four pages of a note size folder letter. States 1st whereas I have given & made deeds to James B. Brooke, Charles F. Brooke & William McK Brooke each 105 A of land in Darke Co, O as their portion of my R.E. 2d I have given & made deeds to my three granddaughters, Catherine R. Taylor, Jane Mooney & Sarah Ann Roberts for 100 A of land in Hancock Co, O this is their portion of my R.E. 3d I give & bequeath to Hannah M. Clawson Closed at 4:30 PM & am back continuing at 8:55 AM Nov 3d and Cliford [sic] Neff Fleming, my granddaughters a tract of land in Union Co, Iowa purchased of D.N. Smith (see deed) ctg 305 A to be equally divided between them both, the prairie & timber & if they can't agree on a "devition" then my Exrs shall appoint two disinterested persons to "make the devition". This is their part of my real estate. 4th, I give to John C. Brooke Jr & Thomas M. Brooke, my two grandsons 420 A more or less in Montgomery Co, Indiana to be equally divided between them by my exrs & "this is their poartion of my real estate". 5. To Asbury Y. Brooke, I give $2000 out of my R.E. to be paid to him when he is of age or as soon as the homestead farm is disposed of by Elizabeth H. Brooke & John C. Brooke Sr my exrs. 6th I give to Elizabeth H. Brooke, my only child & proper heir & John C. Brooke Senr her husband, the farm on which I live after the death of Hannah Finley my wife & to be kept for her maintenance & both of them for their lives & after both have died it is to be sold & after paying Asbury Y the $2000 bals is to be equally divided between all of Elizabeth H. Brooke's heirs. 7th I request all my letters & papers &C &C may be given to Dr C. Thompson of the Delaware Ohio to be disposed of by him as he shall think proper. 8th All the copyright of my books published at the Methodist book room Cincin, O I bequeath to my daughter Elizabeth H. Brooke & all my personal property. 9. Appoint John C. Brooke & Elizabeth H. Brooke "the soul" exrs & direct that they bury me without pomp or show. Dated July 7, 1856 James B.
