All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/oh/ohfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Erma Day ej3ed@verizon.net March 15, 2008, 9:32 pm Source: Preble Co., Oh Will Bk B Pp 79 - 81, Will # 57 Written: July 24, 1822 Recorded: October 25, 1824 In the name of God Amen, I Elijah Horner of the Township of Gratis, County of Preble & State of Ohio being of perfect mind and memory thanks be given to God Calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament, that is to say, Principally and first of all I Give and recommend my Soul into the hands of Almighty God who gave it and my Body I recommend to the Earth to be Buried in decent Christian Burial at the discretion of my Executor nothing Douting But at the General resurrection I shall Receive the Same again by the mighty power of God and as touching Such Worldly Estate wherewith it has pleased God to Bless me in this life I Give devise and dispose of the same in the following manner and form. First I order that all my debts together with my funeral charges be paid Secondly I Give and Bequeath to my wife Prudence all my Real and personal Estate that is to say the half quarter of Land on which I now live together with the ten acres that I purchased of James Randle or the 90 acres of Land on which I now live together with all my household goods Debts and moveable effects to be freely injoid to the day of her death. Thirdly after my Wife’s Death I give and bequeath it to my children in the following manner and form, viz, Fourthly I give and bequeath to my daughter Charlotty Forty five acres of Land on the South division by a line to run parallel with the Southern line together with all the Improvements to be by her freely enjoid forever Fifthly I give and bequeath to my son Jonathan ten acres of Land Joining Elizabeth Platt’s Land after my Wife’s Decease to be by him freely enjoid forever Sixthly I give and bequeath to my daughter Ann wife of James Stiles one dollar together with the Leas on ten acres on which they now live to the day of my wife’s death also the Land during Ann’s lifetime Seventhly I give and bequeath to my daughter Lewcretia Wife of William Rogers one dollar Eighthly I give and bequeath to my son Stacy one dollar Ninthly I give and bequeath to my daughter Eliza Platt one dollar Tenthly I give and bequeath to my son Benjamin all the residue of my real estate not otherwise bequeathed to him forever after my Wife’s decease I likewise constitute make and ordain Gabriel Swaim Jnr. The sole Executor of my last will and testament And I do hereby utterly disavow revoke and disannul all and every other Testaments Wills Bequests and Executions by me in any wise before mentioned willed and bequeathed, ratifying and confirming this and no other to be my last will and testament in Witness whereof I have hereunto set my hand and seal this twenty fourth day of July in the year of our Lord one thousand eight hundred & twenty two Elijah Horner, his mark, (O). Signed sealed published pronounced and declared by the said Elijah Horner as his last will and testament in the presence of us who in his presence and in the presence of each other have hereunto subscribed our names James Tailor Aaron Tailor Edward Tailor The State of Ohio Preble County Ss Be it remembered that at a Court of Common Pleas held in Eaton in the County aforesaid on the 25th day of Oct 1824 Before the Honourable Joseph H Crain esquire and his associate judges of our said court of common pleas came Gabriel Swaim being the executor in the within written last will and testament of Elijah Horner now decd. Which said last will and testament being proven by the oaths of Aaron Tailor and Edward Tailor two of the subscribing witnesses it is ordered that the same be recorded and thereon the said Gabriel Swaim pray administration of the Estate of the said Elijah Horner decd. According to the Terms of the said last will and testament and to him it is granted by order of the court.
