All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/oh/ohfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Camilla Perrill cperrill@neo.rr.com May 23, 2007, 7:11 am Source: Richland County Courthouseo Written: April 5, 1873 Recorded: February 13, 1875 Be it remembered that on the 13th day of February AD 1875 the following Entry was made in the Journal of the Probate Court in and for the County of Richland and State of Ohio, to wit: The Last Will & Codicil of James Shea, deceased… February 13 AD 1875 This date the Last Will and Testament and Codicil to same of James Shea, late of Richland County, Ohio, deceased, was produced in Court, and Rachel Sanders and in open Court upon Oath testified to the due execution of said Will, and that the said Will also appeared in open Court, and testified to the due execution of the same –all of which Testimony was reduced to writing; and the Court being satisfied from Testimony, that said Will and said Codicil were each duly and legally attested and executed, and that said Testator at the time of executing the same was of full age, and of sound mind and memory, and not under any restraint, do admit said Will and Codicil to Probate, and order that said Will and Codicil with the Testimony to same be filed and that the same be recorded in the Will Record of this Court. Keith, Probate Judge Will In the Name of the Benevolent Father of all, I James Shea of Springfield Township Richland County Ohio, being in good Health and of perfectly Sound Mind and Memory, but far advanced in Life, and knowing that it is appointed unto all Men once to die, do make, ordain and publish, this my last Will and Testament. First and principally of all, I give and recommend my Soul to the hands of Almighty God who give it, and my Body to be buried in good decent Christian burial in the Mansfield Cemetery on my own burying Lot at the discretion of my Executors. And as touching such Worldly Estate as it has pleased God to bless me with in this Life, I give devise, bequeath, and dispose of, in the following manner and form. Item 1st I give and bequeath to my Daughter Elizabeth Jane, intermarried with Henry Ogden of Galion Ohio, (during her natural lifetime) the following described Real Estate situated in Crawford County State of Ohio; and more particularly described as being a part of the southwest quarter of section number thirty one (31) in Township number twenty (20) of Range number Twenty (20) and lined and bounded as follows, viz: beginning sixteen and one half feet east of the northeast corner of In Lot number twenty five (25) in Hays and Hosfords Addition of In Lots to the incorporated Village of Galion, thence running south fifteen and one half ////thence east sixty feet, thence north fifteen and one half rods, thence west sixty feet , to the place of beginning what ever it may contain more or less, with all the improvements and appurtenances thereto belonging, she paying all the taxes on the same during her lifetime, and in case she fails to pay the taxes on said property, and it should be sold to pay the same. I hereby authorize my four sons to pay off said taxes, redeem said property, and divided the same equally among the said four share and share alike. And after the decease of my daughter Elizabeth Jane, in case she pays the taxes on said property and thereby holds the same, I give and bequeath said to her heirs forever. Item 2” I give and bequeath to my granddaughter Susan M. Rhodes, and infant daughter, of my daughter Susan M. deceased)(provided she lives to the age of maturity) one thousand dollars, to be kept on interest annually, by the trustee until said child arrives to the age of maturity, and I hereby appoint my son William Shea, trustee to receive and take care of, and keep said money on interest for said child until she arrives to the age of maturity, when he is to pay over the same with he interest to said child (the expenses excepted). Item 3 In case of the death of said child before she arrives to the age of maturity, I give and bequeath said thousand dollars with whatever interest has accrued on the same, to my son Sherman Shea, to be paid over to him as soon as practicable after the death of said child. Item 4 The remainder of all my estate and avails both of personal, and real estate, I give and bequeath to my four sons, John Shea, Alexander Shea, Sherman Shea, and William Shea to be divided equally among them four, share and share alike. Item 5th After my decease, I wish my Executors to sell all my personal and real estate (not bequeathed) as soon as practicable, and my real estate, either at public or at private sale, as they think advisable. I do hereby authorize them to sell in such manner, upon such terms of credit or otherwise, as they may think proper all my real estate, and deeds to purchasers to execute, and acknowledge, and deliver in fee simple. Item 6 I do hereby nominate and appoint Tho. R. Sanders of Springfield Township, Richland County, Ohio, and my son William Shea, Executors of this my Last Will and Testament. I do hereby revoke all former wills by me made. In testimony hereof, I have here unto and seal this 5th day of April AD 1873. James Shea Signed and acknowledged by the said James Shea as his Last Will and Testament in our presence and signed by us in his presence. Rachel Sanders Wm. H. Grove The State of Ohio, Richland County We Rachel Sanders and Wm. H. Grove being duly sworn, in open Court, this 13th day of February AD 1875, depose and say that we were present at the execution of the Last Will and Testament of James Shea, deceased, Hereunto /////; that we saw said testator subscribe said last will, and him publish and declare the same to be his Last Will and Testament, and that we signed the same as witness at his request, and in his presence, and in presence of each other. Whereas I James Shea, did on the 5th day of April in AD 1873, make and publish my Last Will and Testament of that day; and whereas my son, Alexander R. Shea, since the making of my said Last Will and Testament, has become indebted to me and shall remain indebted to me in the sum of ($1,0000) 0ne thousand dollars, as shown by a note which I hold against my said son Alexander bearing date September 19th 1873, and payable on demand, without interest, now, therefore Know all men by these presents, that I James Shea, of Mansfield, Richland County Ohio, being of full age and of sound and disposing mind and memory, do make, publish and declare the following to be a Codicil to my said Last Will and Testament. It is my will that, in the settlement of my estate, the said indebtedness of my said son, Alexander R. Shea, or so much thereof as shall remain unpaid at my death, shall be treated as so much money advanced to my said son Alexander, as part and parcel of his share of my said estate, and be received by him in lieu of and as equivalent for the sum of $1000.00 in cash, in case no part of the said indebtedness shall have been paid before my death; and said note to be received by said Alexander R. Shea in lieu of and as equivalent for a sum equal to the amount of the principal of said note which shall remain unpaid at my death; and it is further my will that my Executors shall not enact any interest upon said note from my said son, Alexander R. Shea. In testimony whereof, I have hereunto sent my hand and seal the 2oth day of September in the year 1873.
