The Plaintiff appearing by his attorney, and it appearing to the satisfaction of the court, that some of the parties of whom partition is demanded, are not residents of the state of Ohio, therefore it is orderd by the Court, that notice of the pendency of said petition be published in the OHIO REPOITORY, for six weeks successively, the last of which publications to the forty days before the next court. The John Spitler named was residing in Huntingdon County, Pennsylvania. William Spitler [Sr.] had come from Huntindon County, PA to Ohio about 1811. William Spitler [Jr] named in the suit was specifically named as a son in a deed in Stark County, Ohio in 1814 [Deed Book C;529] Simon Spitler was residing in Wayne County, Ohio in 1850.
