I. APPLICATION FOR PROBATE OF WILL Probate Court, Wood County, Ohio In the Matter of the Last Will and Testament of Michael Roether, deceased. Application to Admit to Probate TO THE PROBATE COURT OF SAID COUNTY: Your petitioner respectfully represents that Michael Roether, late a resident of the township of Perrysburg, in said County, died on or about the 24th day of April A.D. 1901, leaving an instrument in writing, herewith produced, purporting to be his last Will and Testament. That the said Michael Roether died, leaving no widow but the following named persons his only next of kin, to-wit: Thomas Roether Son Perrysburg, Ohio Christian Roether Son State Hospital, Folely Ohio Catherine Brown Daughter Toledo, Ohio Adolph Roether Son Perrysburg, Ohio Henry Roether Son Perrysburg, Ohio Anna Roehter Daughter Perrysburg, Ohio George Roether Son Toledo, Ohio Julia Roether Daughter Perrysburg, Ohio Your petitioner offers said Will for Probate and prays that a time may be fixed for the proving of the same, and that said above named persons resident in this State may be notified according to law of the pendency of said precedings. The above named Henry Roether, being first duly sworn, says that the facts stated and allegations in the foregoing application contained, are true as he verily believes. Henry Roether Sworn to before me and signed in my presence this 30th days of April, AD 1901 Stpehen A. Angus, Probate Judge II. Last Will and Testament In the name of the benevolent Father of all: Be it known that i Michael B. Roether of Perrysburg, Wood county, Ohio do publish this as my last will and testament: Item 1. I direct my executers hereinafter named to pay out of my estate as soon as possible after my decease all my just debts, together with the expense of my last sickness and my funeral and testamentary expenses. Item 2. I give and bequeath to my daughters, Anna Roether and Julia Roether, the home and lots, No. Four Hundred and seventy-one (471) and lot No. Four Hundred and sixty six (466) also the chattle property, and one hundred ($100.00) dollars each. Item 3. I give and bequeath to my son Christian Roether the some of Five ($5.00) dollars, and that the balance of my moneys and lots No. 523 and 447, be equally divided among the heirs as follows to wit: Thomas Roether, Katherine Roether, Adolph Roether, H.R. Roether, Anna Roether, and Julia Roether and George Roether. Item 4. It is my desire that the balance of my real estate not heretofore mentioned shall be equaly (sic) divided among all the heirs. Item 5. I hereby appoint my sons Thomas Roether and Henry R. Roether as the executors of this my last will and testament, I hereby revoke all former wills made by me. IN PROBATE COURT. In the matter of the last Will and Testament of Michael Roether, deceased. To Henry Roether You are hereby commanded to notify Thomas Roether, Christian Roether, Catherine Brown, Adolph Roether, Henry Roehter, Anna Roether, George Roether, and Julia Roether Giving at least five days notices. That on the 30th day of April, A.D. 1901, an instrument of writing, purporting to be the last Will and Testaments and Codicil thoughts of Michael Roether late of Perrysburg Township, in said County, deceased, was produced in open Court, and an application to admit the same to probate, was on the same day made in said Court. Said application will be for hearing before this Court, on the 18th day of May A.D. 1901 at 10 o'clock a.m. Herein fail not, but of this write and services thereon, make due return. I, H R Roether, being duly sworn, say that on the 13th day of May, 1901, I served this write by delivering a copy thereof to the following named persons, to-wit: Thomas Roether, Christian Roether, Catherine Brown, Adolph Roether, Henery Roether, Anna Roether, George Roether, and Julia Roether. PROBATE OF WILL THE STATE OF OHIO, Wood County IN PROBATE COURT Personally appeared in open Court, Phillip Wetzel and Charles Dauer the subscribing witnesses to the last Will and Testament of Michael Roether, late of Perrysburg Township in said Wood County, deceased; who being duly sworn according to the law, to speak the truth, the whole truth, and nothing but the truth, in relation to the execution of said Will, depose and say: That the paper before them bearing date the 24th day of January, A.D. 1901, purporting to be the last Will and Testament of Michael Roether, now deceased, is the Will of said deceased Michael Roether that they were present at the execution of said Will, and at the request of the Testator respectively subscribed their names to the same as witnesses, in his presence,; that they saw the said Michael Roether, deceased, sign and seal said Will, and heard him acknowledge the same ot be his last Will and Testament, and that the said Michael Roether at the time of making and signing said Will, was of full age, of sound mind and memory, and not under any restraint: Philip Wetzel Charles Dauer Sworn to and subscribed by said witnesses, in open Court, this 18th day of May, A.D. 1901 Stephen A. Application for Letters Testamentary THE STATE OF OHIO, Wood County To the Probate Court of Wood County H R Roether, being duly sworn, says that Michael Roether, late a resident of the Township of Perrysburg in said County, died testate on or about the 24th day of April, A.D. 1901, leaving no widow and the following persons his only heirs at law: Thomas Roether Son Perrysburg, Ohio Christian Roether Son State Hospital, Folely Ohio Catherine Brown Daughter Toledo, Ohio Adolph Roether Son Perrysburg, Ohio Henry Roether Son Perrysburg, Ohio Anna Roehter Daughter Perrysburg, Ohio George Roether Son Toledo, Ohio Julia Roether Daughter Perrysburg, Ohio The undersigned allow for the appoinrtment of an Executers (sic) of said decedent, and in his ??? , the amount of personal property will be about $1500.00 And of real estate, about $2000.00 Total $3500.00 Henry Roether Sworn to before me, and signed in my presence, this 18th day of May, A.D. 1901 Stephen A. EXECUTOR'S BOND Know all Men by these Presents, That we Henry Roether and Thomas Roether, as princiapl, and D K?? abd Phillip Wetzel, as ??, of the county of Wood in the State of Ohio, are held and fimly bound by the State of Ohio, in the penal sum of Three Thousand ($3000.00) Dollars, to the payment of which sum, well and truly to be made to said State of Ohgio, we do bind ourselves, our heirs, executors, and administrators, ?? and ?? by these presents. Sealed with our ?? and dated the 18th day of May in the year One Through Nine Hundred and Ninety One (sic) The combition of the above Obligration is suc, that if the above bound Henry Roether and Thomas Roether executors of the last Will and Testament of Michael Roether, deceased, late of Perrysburg Township in the County of Wood aforesaid: First, shall make and return to the Probate Court within and for said County, on oath, within three months, a tryr inventory of all of the moneys, goods, chattels, rights, and credits of the testator which are by law to be administered, and which shall have come to their possession or knowledge, and also, if required by said County, an inventory of the real etate of the deceased: Second,. that they shall administer, according to law and to the Will of the testator all his goods, chattels, rihts, and credits, and the proceeds of all his real estate that may be ?? for the payment of his depts or legacies, which shall at any time come to their posession or to the posession of any other person for them. Third, Shall render upon with a just and true account of their administration, within eighteen months, and at any other time where required by said Court or the law; and ???? for thirty days after, they shall have been notified of the expiration of the time, but the Probate Judge they shall received no allowance for services, unless the Court shall enter yupon the Jornal that such delay was mandatory and reasonable, then this obligation to be void, otherwise to remain in faith and virtue in law.
