Lucas of Elk City, charged with murder in connection with selling whiskey that caused the death of Lowell Owens on October 31, was bound over to the next term of district court without bond by County Judge H. C. Hubbard in the continued preliminary hearing Monday at Cordell. Lucas has filed a habeas corpus petition and it was heard by District Judge E. L. Mitchell on December 3. Dr. B. W. Baker, who made an examination of Owens soon after his death, and Phil Ashby, state chemist who made an analysis of the whiskey alleged to have killed the 18-year old Texas youth testified during the last Monday's hearing. The chemist's analysis showed that the whiskey contained 31.88 per cent alcohol, or 5.1 absolute alcohol per pint. A fatal dose for an adult is from 2.5 to 5 ounces, doctors say, and Owens is said to have taken over a pint of the whiskey in a very short space of time.
