GARRETT I, George W. GARRETT, of Elk City, Roger Mills County, and Territory of Oklahoma, being now of sound mind and memory and in the possession of all my faculties, do hereby make, publish, and declare the following to be my last will and testament, hereby revoking and cancelling all other or former wills by me at any time made. ARTICLE FIRST. I direct the payment of my funeral expenses and of all my just debts if there be any against me. ARTICLE SECOND. I give, devise and bequeath to my wife, Ida M. (SAMPSON) GARRETT, all of the personal property, of whatsoever kind or character, which may belong to me at the time of my death, and which at the present time is composed of the following goods and chattels, to wit: Two mules, One horse, one buggy, two cows, one farm wagon, four sets of harness, one kit of carpenters tools, farming tools, now on my farm, one note for three hundred and fifty dollars, endorsed by one--Vinson with John LUCAS and J. T. LUSK as sureties, and four hundred seventy five and 26/100 dollars. ($475.26) now on deposit in the First National Bank of Elk City, Oklahoma. ARTICLE THIRD. I give, devise and bequeath my real property, to wit: The south half of the south west quarter (S l/2 of S.W. l/4) and North west quarter of South west quarter (N.W. l/4 of S.W. 1/4) of Section Nine (9) and the South east quarter of South east quarter (S.E. l/4 of S.E. 1/4) of Section Eight (8) in Township Ten (10) North of Range Twenty one (21) West of Indian Meridian; and Lots Thirteen (13) and Fourteen (14) in Block Two (2) of Winns addition to the city of Elk City, Oklahoma Territory to my children namely, Mrs. Cora M. FISH, Henry R. GARRETT and Maud L. GOWDY but subject to the following conditions, to wit: First. That the property shall not be sold nor divided during the lifetime of my wife, Ida M. GARRETT, provided that she remains my widow after my death. Second. That so long as my wife, Ida M. GARRETT, remains my widow she shall have full and exclusive control of all of the above described real property and shall have all of the income derived therefrom for her exclusive use and benefit. Third. That if my wife, Ida M. GARRETT, remarries, after my death, then the above described real property shall be immediately sold and the money received therefor be divided into as many portions, or shares as there may be children of mine living, or deceased, leaving issue; one of the said shares or portions of my estate shall be set over, conveyed and assigned to each of my said children, and one of the shares or portions to the lawful issue of any of my said children who may be dead at such time, such issue to have the share or portion that their parent would have been entitled to if living. ARTICLE FOURTH. I further direct and will that at the death of my wife, Ida M. GARRETT, she remaining my widow, the real property be sold and the proceeds divided as set forth in the third provision of the third article herein. ARTICLE FIFTH. I further direct and will that in the event I shall survive my wife, Ida M. GARRETT, all of my estate real and personal property of whatsoever kind or character whereof I may be seized or possessed, or in any manner entitled to, at the time of my death be sold and the proceeds be divided as provided in the third provision of the third article herein. ARTICLE SIXTH. I further direct and will that at the death of my wife, Ida M. GARRETT, or at my death, if I should survive my wife, my children, or a majorite of them, shall choose a person agreeable to them, and such person so chosen shall be the executor of this my last will and testament and shall serve as such without giving bond or any security whatsoever. In witness whereof, I, George W. GARRETT, have to this my last will and testament consisting of two sheets of paper, subscribed my name this 15th day of August 1907. George W. Garrett Subscribed by George W. GARRETT in the presence of each of us, the undersigned, and at the same time declared by him to us to be his last will and testament, and we, thereupon at the request of George W.
