                         LAST WILL AND TESTAMENT OF,
                         William Franklin Rutherford
State of Oklahoma
County of Beckham
                                                           I, W. F. Rutherford,
 of Sayre, Beckham County Oklahoma, being now in good health, strength of body
and mind,but sensible to the uncertainty of life, and desiring to make 
desposition of of all my property and affairs,while in health and strength, 
do hereby, make, publish, and declare this to be my last will and testament, 
hereby revolking and canceling any or all wills at by me at any time made.
                                                           
1.  I direct the payments of all my just debts and funeral expenses.
                                                           
2.  I give and devise to my wife LULU RUTHERFORD all of my property both
real  and personal,of every kind and wherever situated, whether vested or
contingent, at the time of my death, to belong to her as long as she
lives, and at the time of her death, I give and  bequeath this property to
my children to wit:

                                                            Eva Rice
                                                            Roger Rutherford
                                                            Joe Rutherford
                                                            Dora Berrier
                                                            Paul Rutherford
                                                            Jessie Burden
                                                            Hershel Rutherford
Share and share alike,and each to receive in equal proportions.In case any of 
my children shall died in my lifetime, or the lifetime of  their mother LULU 
RUTHERFORD, leaving issue or descendents,I direct that their share shall
not lapse, but shall be paid the to such descendents in equal proportions.
                                                              
3.  I hereby appoint and designate my wife LULU RUTHERFORD my sole
executrix, without bond of this my last will and testament.


        IN WITNESS THEREOF, I W.F. Rutherford have to this my last will and 
testament, consisting of two (2) sheets of paper, subscribed my name
thisw 22nd day of November 1933.

W. F. Rutherford in the presence of each of us, the undersigned, and at
the same time declared by W. F. Rutherford to us to be his last will and
testament, and we thereupon at the request of W.F. Rutherford, in his
presence and in the presence of each other, sign our names hereto as
witnesss this 22 day of November 1933 at  Sayre ,Oklahoma Beckham County.
