Testimony #7870 and 9248/1757 In regards to James Waterfallen and Wilda Waterfallen, his present wife. I was enrolled by the Dawes Commission. I was enrolled under the name James Waterfallen, #25970. My wife at that time was Eliza Waterfallen. She died in the year 1903. I had three children by my first wife. Their names and present ages are Eli, 18 years old #25972, Annie, who died in May 1808 (1908) #25973, and Bessie, 8 years old #25974. My present wife is Wilda Waterfallen. I have one minor child by my present wife. He was born Dec. 3, 1904. He is still living. His name is John Waterfallen. He was not enrolled with the minor Cherokees. I never had him enrolled. The Night Hawk leaders told me not to have him enrolled and I neglected to have him enrolled. I let it pass by until it was too late. ( This child was present and I saw him. He was at least five years old. His name does not appear on the Minor Cherokee Roll of the Dawes Commission. F. A. Baker) I think I filed a supplemental application for this money at Saline Court house, Okla. Joe Wilson made out my application. I think I filed for Eli, Annie, Bessie, and John. My wife Wilda Waterfallen has been married twice. She was enrolled by the Dawes Commission under the name of Wilda Johnson. Her first husband's name was Blew Johnson. Her Dawes Commission was #18816. (Note - The first husband's name was Blue Johnson. He died about 1903.) The children of my wife by her first husband were Davis, now about 21 years old #18817, Andrew, now about 19 years #18818, and Levi, now about 16 years old #18819. The above children are living with me and my wife at the present time. I think my wife made applications for her children for participation in the Eastern Cherokee fund. My present Post Office is Gideon, Okla. Filed for by James Waterfallen, Gdn. in #7872. Subscribed and sworn before me this 29th day of March, 1909, at Tahlequah, Okla. F. A. Baker Assistant to the Special Commissioner of the U. S. Court of Claims
