WARRANTY DEED With Lien and Relinquishment of Dower ~~~~~~~~~~~~~~~~~~~~~~ Know all Men by These Presents: THAT WE J.M. MayBerry and L.E. MayBerry his wife for and in consideration of the sum of Seven Hundred & Seventy Five DOLLARS paid and to be paid by J.C. Long as follows, to wit: Five Hundred dollars cash in hand (receipt of which is hereby acknowledged) and Two Hundred & Seventy five dollars note, due Oct. 1, 1906 bearing interest from date until paid, at the rate of 8 per cent per annum, do hereby grant, bargin and sell unto the said J.C. Long and unto his heirs and assigns forever, the following lands lying in the Chickasaw Nation of Indian Territory, to-wit: N. W 1/4 of N. W 1/4 of Sec. 17 2.6 S. R 7 E., N.E. 1/4 of S. W 1/4 of N. W 1/4 of Sec. 17. 2.6 S. R 7 E. To have and to hold the same unto the said J.C. Long and unto his heirs and assigns forever, with all appurtenances thereunto belonging And granters hereby covenant with the said J.C. Long that he will forever warrant and defend the title to said lands against all claims whatever, and that said lands are free from all liens and encumbrances it being herein expressly understood that a lien is hereby retained upon said lot or parcel of land to secure the pay-ment of residue of the purchase money hereinbefore mentioned. And I, L.E. Mayberry wife of the said J. M. Mayberry for and in conderation of the said sum of money, do hereby release and relinquish unto the said J.C. Long all my rights of dower and homestead in and to the said lands. WITNESS our hands and seals on the 28 day of July 1905 (singature) J.M. Mayberry [L.S.] (singature) L.E. May berry [L,S,] _____________________________________________ ACKNOWLEDGMENT ~~~~~~~~~~~~~~~ INDIAN TERRITORY SOUTHERN DISTRICT, BE IT REMEMBERED, That on the dad come before me, the undersigned, a NOTORY PUBLIC within and for the County and Territory, aforesaid, duly commissioned and acting J.M. Mayberry to me well known as the grantor in the foregoing Deed, and stated that he had executed the same for the consideration and purposes therein mentioned and set forth, And on the same day also voluntarily appeared before the said NOTORY PUBLIC L.E. Mayberry wife of the said J.M. Mayberry to me well known, and in the absence of her said husband declared that she had, of her own free will, executed said Deed and signed and sealed the relinquishment of dower and homestead in the said Deed for the consideration and purposes therein containd and set forth, without compulsing or under influence of her said husband.
