Do you know that Fencer and his wife were living at the present time? A. Yes, sir Fencer and his wife Aggie Fencer will be placed upon straight card. Subscribed and sworn to before me this 28th day of April, 1902 DEPARTMENT OF THE INTERIOR Commission to the Five Civilized Tribes In the matter of the death of Fencer, a citizen of the Cherokee Nation, who formerly resided at or near Roach, Indian Territory, died on the 14th day of July 1902. AFFIDAVIT OF RELATIVE United States of America Indian Territory Northern District I, Dick Carcawee, on oath, state that I am 58 years of age and a citizen, by blood, of the Cherokee Nation; that my post office address is Oaks, Indian Territory; that I am ‘the niece’[sic] of Fencer, who was a citizen by blood, of the Cherokee Nation; and that said Fencer died on the 14th day of July, 1901. Kingfisher, on oath state that I am 34 years of age, and a citizen by blood, of the Cherokee Nation; that my post office address is Oaks, Indian Territory; that I was personally acquainted with Fencer who was a citizen, by blood, of the Cherokee Nation; and that said Fencer died on the 14th day of July 1902. Samuel Foreman Notary Public DEPARTMENT OF THE INTERIOR Commission to the Five Civilized Tribes Muskogee, Indian Territory March 15, 1905 Samuel Foreman Tahlequah, Indian Territory Dear Sir: On October 19, 1903, you testified in the matter of the application of Fencer for the enrollment of himself and wife, Aggie Fencer, as citizens of the Cherokee Nation. You stated at that time that Aggie Fencer died sometime during the year of 1902. The Commission is in receipt of your letter of February 15, 1905, in which you state that Aggie Fencer is not dead. There is herewith enclosed blank form of affidavit which you are requested to have properly executed and return to the Commission at the earliest possible date, in order that the rights of Aggie Fencer to enrollment as a citizen by blood of the Cherokee Nation may be finally determined.
