(Hands over paper) Applicant presents a duly authenicated marriage license issued by the authorities of the United States, certifying that he was married to Miss Victoria James on the 10th day of April, 1896, and duly authenticated certificate to just effect. The license will be filed. Q. Have you always lived in the Cherokee Nation? A. Yes, sir Q.Are these children all living at this time, these three, Bean, Albert, and Aaron? A. Yes, sir, they are living now Q.They are children of Victoria? A. Yes, sir Com’r.Needles: Green Terrell applies for the enrollment of himself, as a Cherokee by Blood, his wife, as a Cherokee my intermarriage, and his three children, Bean, Albert and Aaron, as citizens by blood. He is duly identified upon the authenticated roll of 1880 as well as the census roll of 1896. His wife Victoria is identified upon the census roll of 1896, and he presents satisfactory proof of his marriage to his wife Victoria, in the month of April, 1896, too late under the laws of the Cherokee Nation for intermarried whites, to acquire rights by intermarriage. He states that he was formerly married to Nannie Terrell, and Nannie Terrell is duly identified upon the authenticated roll of 1880. She is now deceased. By said marriage, he had one son, Aaron, who is duly identified upon the authenticated roll of 1896. It will be necessary for applicant to file satisfactory proof of birth of his two younger children, Bean and Albert, their names not appearing upon any of the rolls of the Cherokee Nation. He makes satisfactory proof as to residence and is duly identified according to the pages and number of the rolls as indicated in the testimony, consequently Green Terrell and his three children, are enumerated within, will be listed for enrollment as Cherokees by Blood. From the fact that he was married to his wife, Victoria, a white woman, too late under the laws of the Cherokee Nation to acquire citizenship, the application for the enrollment of his wife, Victoria will be rejected. AFFIDAVIT OF RELATIVE United States of America Indian Territory Northern District I, Green Terrell, on oath states that I am 55 years of age and a citizen, by blood, of the Cherokee Nation; that my post office address is Manard, Indian Territory; that I am Father of Albert Terrell, who was a citizen, by blood, of the Cherokee Nation; and that said Albert Terrell, died on the 22nd day of August, 1903. AFFIDAVIT OF ACQUAINTANCE United States of America Northern District I, Mrs. Oma Robertson, on oath states that I am 31 years of age, and a citizen, by adoption, of the Cherokee Nation; that my post office address is Manard, Indian Territory; that I was personally acquainted with Albert Terrell who was a citizen by Blood of the Cherokee Nation; and that said Albert Terrell died on the 22nd day of August, 1903.
