Testimony in case indicate that some of ancestors on both paternal and maternal sides were Creeks. J. B. Adair states that the paternal side were Creeks and Steve Simmons, applicant # 9875 testified (# 3973) that Jess Simmons or Jess Long, his maternal grandfather and also of applicant # 13111, was a Creek. None of applicant’s ancestors appear on any Cherokee Roll. See Misc. Test. P. 3973. Commissioner of Indian Affairs Washington, D. C. Sir: I hereby make application for such share as me be due me of the fund appropriated by the Act of Congress approved June 30, 1906, in accordance with the decrees of the Court of Claims of May 18, 1905, and May 28, 1906, in favor of the Eastern Cherokees.
