Testimony in case indicate that some of ancestors on both paternal and maternal sides were Creeks. J. B. Adair states that the paternal side were Creeks and Steve Simmons, applicant # 9875 testified (# 3973) that Jess Simmons or Jess Long, his maternal grandfather and also of applicant # 13111, was a Creek. None of applicant's ancestors appear on any Cherokee Roll. See Misc. Test. P. 3973. Commissioner of Indian Affairs Washington, D. C.
