[page] Affidavit of Henry Henson Case of R. F. Hamilton State of Texas, County of Milam - Before me H. E. or W. E Witherspoon a notary public in and for Milam County and State of Texas Personally appeared Dr. Henry Henson who is well know to me as a reliable citizen of said county and state and who upon his oath being duly sworn by me deposes and says My name is Henry Henson I was born in Rabun Co GA I am 70 years old. My fathers name was James B Henson and he was lawfully married to Elizabeth Tally who was a half breed Cherokee Indian by blood in Rabun Co GA and her mother's maiden name was SUSAN WALKINGSTICK and she was a full blood Cherokee Indian my father and his famiy was moved togeather with abour 400 Chserokee in 1832 or 1833 to Arkansas and they settled on Illinois River and stayed there about 2 years. We drew rashons from the US at the Cherokee Agency. My father moved there with his family to Texas. I was married to Mary Ann Hudman in Rusk Co TX in the year 1848 We had as a rusult of our marriage 15 children. eight of whom are still living, 7 are deat three of whom ahve children living. The names of our children who are living are as follows to wit: James W Henson, William T Henson, Sarah Henson who married William J Waggoner and who is now dead and left threee children to wit: Matilda Ann Waggoner who married Robert F Hamilton whose application for citizenship is now on file in the Cherokee Nation, Lula Waggoner who married Samuel Smith and who now lives in Coffman Co TX and Henry B Wggnor who also lives in Coffman Co TX. Martha J Henson who also married the same W. J. Waggoner and who is still living. Josephene Henson who married J. W. Rabun and who is now dead and left one child. Susan Henson who maried William Stilts and who is now livng. ___ V Henson who married John Maberry and who is still living. Henrietta Henson who married Jasper W Orr whose application for citizenship in the Cherokee Nation is also now on file. Louisa Henson who married Charles R Perry and who is now living. Marietta Henson who married William Rudney and who is now dead and left two children. Annie Henson who married Daulph Spradling and who is now living. My children are 1/8 Cherokee Indian by blood. I am 1/4. My bother was 1/2. My grandmother was a full blood. My father and mother are both dead. This affidavit is made for the purpose of procuring a right in the Cherokee Nation for those of my children who may apply for the same to which they are justly entitled. August 11, 1893. Henry Henson A list of names as I remember who came with my father and his family from North GA either in 1832 or 1833 to Arkansas Robert Simons and wife Rebecca Simons Finny Kell and his sister Nancy Kell Will tucker and Nancy Tucker John Tucker and his wife Ruby Tucker James Walkingstick and wife Lida Quinton Jennie Blackwell and a Mr. Ward and his family Early Cordery Dick Henson Terrell Henson James Henson and Wash. Henson was cousins of mine. I expect nearly all of these are dead long ago. I have forgotten a great many that came with us whos names I onece knew it has been so long ago. Terrell Henson married Nella Tucker. I dont remember who Dick Henson married. Wash. Henson had three wives all sisters and raised families by them all. I do not know who James Henson married. I have heard my father and mother say that they were related to the Vans and also to Boudinot that was killed by the Ross party in 1836 or 1838 and also related to Old Nancheer (?) Nauchur (?) who was nearly a full blood Cherokee. This is about all that I can call to mind just now. Only Matilda A Hamilton is a grandaughter of mine. Henry Henson, MD P.O. Gano, Wiliamson Co TX State of Texas County of Milam Before me W E Witherspoon a notary public in and for Milam Co TX on this day personally appeared Dr. H. Henson well kown to me who after being by me duly sworn on his oath says That his mother Mrs Elizabeth Henson was a quarteroon Cherokee Indian That she moved rom NC to the Cherokee part of GA about the year 1815 That she and my father were married in GA about the year 1820 That they emigrated to AR with abour 400-500 other Cherokees about the year 1833 and remained there about 2 years That during this 2 years time we drew supplies from the US government That I have but faint recognition/recollection of my mothers ancestry. That her grandmother was a full blooded Cherokee woman and her name was Susan Walkingstick. Witness my hand this 27th day of Dec 1892. H. Henson Cherokee Nation Papers Item #3194 Tahlequah C. N. July 20, 1880 Hon. D. Bushyhead, Principal Chief Dear Sir: I here with submit a statement in my case for your information and consideration to the affect that I am not a citizen of the Cherokee Nation and therefore disclaim any of the rights and ____ arising there of. And there is no good reason why I should be enrolled on the _____ Census roll as a citizen when I am not (when I am not underlined) These statements are facts that are proven by good and reliable citizens of the nation men of my own color who have been acquainted with me ever since I first came in the nation. Also Liza Springwater a Cherokee woman that I have been living with have made affidavits to that effect. In conclusion will state I sent the money to the Clerk of Cooweeskoowee Dist to pay for a certified copy of all the papers in my case His reply was that he was so busy that he could not attend to it under the circumstances I feel that I am illegally held here as a convict and therefore ask an early consideration of my case all of which is respectfully submitted. Your Obt Servt Henry Henson #3194 Cherokee Nation, Tahlequah Dist Personally came before me Allen Ross Clerk of the aforesaid dist, Henry Henson alias Burrell who being qualifed states that he never was married to Lizzie Water Spring according to the laws of the Cherokee Nation regulating intermarrige with citizens of the US and Csherokees He therefore claim to be a citizen of the US and not under the jurisdiction of the laws of the Cherokee Nation. 27 Mar 1880 Henry Henson x alias Burrell 27 Mar 1880 Affidavit from Lizzie Water Spring of Cooweescoowee dist......says she never married Henry Henson...... 9 April 1880 Allen Ross testified that he first knew Henry Henson alias Burrell when he was a soldier in the US Army about 10 years ago and that he is now the the National Prison, but never knew him to claim any rights.
