Sir: You have on file in this office application # 7501 and # 36281 for a share of the money appropriated for the Eastern Cherokee Indians, on which you state that you base your claim to Cherokee blood by right or Julia Ann Scruggs, your mother, who was the daughter of Benson Pack and Mary Pack, nee Evans. You further state that you do not know whether they were ever enrolled, and that you have never been enrolled for any money, annuities, land or other benefits in the Cherokee Nation. Who was your full-blood Cherokee Indian ancestor? Where did he or she reside in 1835, if living at that time? I notice that you state in answer to question 22 that your great grandfather on your mother’s side was Charles Evans, a Cherokee, and that your great great grandfather on your mother’s side was Jonathan Evans, a Cherokee who lived in the Old Cherokee Nation in North Carolina. I cannot find the name of Jonathan Evans, Charles Evans, or Mary Evans upon the roll of 1835. Why were not those people enrolled? Did your full-blood ancestor, whoever he or she may be, live in the East in 1835, or in the West? That is, west of the Mississippi River? If living in the West, in what part of the West did said full-blood ancestor reside in 1835 or 1851? Do you know of any reason why your ancestors, who you claim to be Cherokee Indian by blood, were not enrolled in 1835 or 1851? You also state that Benson Pack, your grandfather, on mother’s side was Cherokee…. (transcriber note; unfortunately this is all I have of this letter.) I did not file for myself for I do not have any Indian blood. My sons claim through their mother. I came here in the year ’70. James C. and John P. and D.G. Scruggs are my sons. They get their Indian blood from their mother, Cherokee. We came from Tennessee near the North Carolina line. Her maiden name was Julia Ann Pack. My wife was not enrolled by the Dawes Commission as the promised us that they would fix it, but they never did. They were rejected. She was now enrolled for the strip money. Did not make application, as they kept us out from time to time after getting money from us. My wife has been dead 20 odd years. She died in 1883 at the age of about 32 years old. I don’t think she was enrolled in 1851. She got her blood from her father Charles Evans. He was born and raised in North Carolina. I cannot find out whether he was enrolled. Benson Pack got his blood from his other, I think she was a CRUMBY. I don’t know whether any of these people were enrolled. My wife’s people lived in Tennessee and her husband would not make a living for them. They were probably away from the tribe. My wife’s mother had a brother, John, Tom, and a sister by the name of Prudence. He father had a brother, Elias Pack, now dead. I don’t know anything of my wife’s grandparents except a brother Jack. I do not know whether any of them were regarded as Old Settlers. I do not know whether they ever joined any other tribe.
