Submitted by Catherine Widener ( catz@kcisp.net ************************************************************************ Lucinda was rejected . It appears from the testimony of the applicant, that her mother was born November 10, 1835 at Fort Leavenworth, Kansas and therefore she could not have been a party to the treaty of 1835-6. The father of applicant was a white man. The names of the ancestors of applicant through who she claims her Cherokee blood, do not appear upon the rolls of 1835 or 1851, either Emigrant or Old Settler roll. While the applicant was enrolled by the Dawes Commission, it clearly appears from the testimony that if her ancestors were Cherokees, they left the Eastern Cherokee domain before 1835 and therefore were not parties to the treaties of 1835-6 and 1846. For information corroborating the finding herewith, see Misc. Test. P. 2924, 4115 and 4369. See statements under "Remarks" in Applications 1398, Supl. # 1398, # 11894, Question 21, and Question 21, # 10918. See also Letter in # 1398 written by Stephen D. C. Edwards, Chaffee, Oklahoma. Misc.
