P. DAVENPORT Judge of the County of Pushmataha Oklahoma. Come your petitioner W. H. ISHERWOOD and respectfully show to the Court: First That on or about the ________day of __________ 1904 NICHOLAS BOHANAN died intestate, at his home near Tuskahoma in Pushmataha County, Oklahoma. That the deceased at the time of his death was a resident of the said estate. That deceased at the time of his death was a resident of C?? Dist- Ind Ter. and that this court has jurisdiction in the settlement of the said estate. That deceased at the time of his death was the owner in fee simple of certain real estate located in Pushmataha County, State of Oklahoma, which said real estate was allotted to him as a full-blood Choctaw Indian, and that the said real estate so allotted to him is described as follows, to wit: NE 1/4 of SE 1/4 and SE 1/4 of NW 1/4 of SE 1/4 and N 1/2 of SE 1/4 of SE 1/4 and S1/2 of SW 1/4 of SE 1/4 and NE 1/4 of SW 1/4 of SE1/4 of Sec 32. and SW 1/4 of NW 1/4 of SW 1/4 of Sec 33 Twp. 2 N. R. 19 Est. and the NW 1/4 of the N W 1/4 of SW 1/4 and the SW 1/4 of the SW 1/4 of NW 1/4 of Sec 33 and SE 1/4 of SE 1/4 of NE 1/4 of Sec 32 Twp 2 N. R. 19 East. and SW 1/4 of SW1/4 of NW 1/4 and N 1/2 of SW 1/4 of NW 1/4 and SW 10 acres of lot 4 Sec 4. and SE 10 acres of lot 1, and NE 1/4 of SE 1/4 of NE 1/4 of Sec 5 Tp. 1 N. R. 19 E. and NW 1/4 of SW 1/4 of Sec 3 and NW 1/4 of SW 1/4 of NW 1/4 of Sec 16 Tp. 2 N. R. 18 East and being of the Government appraised value of ___________________________________Dollars. That said deceased appears on the Choctaw Roll by blood, opposite Roll No. Second. That your petitioner states that JINCY ANDERSON enrolled as a full blood and ELLIS BOHANAN, SIMPSON BOHANAN, ROBERT BOHANAN, and GREEN BOHANAN, WILSON BOHANAN, WESLEY BOHANAN, MATILDA BOHANAN, and NANCY BOHANAN (wife) are respectively the sole and only surviving heirs at law of the said NICHOLAS BOHANAN deceased. Your petitioners further show that on the 22 day of January 1907 in the town of Tuskahoma in Pushmataha County, State of Oklahoma, for and in consideration of the sum of One hundred and thirty three 33/100 Dollars, cash in hand to them paid by W. H. ISHERWOOD the receipt of which amount is acknowledged, said him executed and delivered to the said W. H. ISHERWOOD their certain Warranty Deed, conveying unto the said W. H. ISHERWOOD the real estate above described, in fee simple. that the consideration of the said deed is reasonable, adequate, and in all things satisfactory to said heirs. WHEREFORE, the premises considered, your petitioners pray that this Court enter its order confirming and approving the said conveyance to the said W. H. ISHERWOOD, as to JINCY ANDERSON, a full blood and in all things to declare the said sale and conveyance legal and valid. Signed W. H. ISHERWOOD. STATE OF OKLAHOMA COUNTY OF PUSHMATAHA SS. W. H. H. ISHERWOOD and file and presents to the Court his petition, praying for an order of the Court approving and confirming a certain deed of conveyance executed to him on the day of 1904 to the following described real estate to-wit: NE 1/4 of SE 1/4 and SE 1/4 of NW 1/4 of SE 1/4 and N 1/2 of SE 1/4 of SE 1/4 and S1/2 of SW 1/4 of SE 1/4 and NE 1/4 of SW 1/4 of SE1/4 of Sec 32. and SW 1/4 of NW 1/4 of SW 1/4 of Sec 33 Twp. 2 N. R. 19 Est. and the NW 1/4 of the N W 1/4 of SW 1/4 and the SW 1/4 of the SW 1/4 of NW 1/4 of Sec 33 and SE 1/4 of SE 1/4 of NE 1/4 of Sec 32 Twp 2 N. R. 19 East. and SW 1/4 of SW 1/4 of NW 1/4 and N 1/2 of SW 1/4 of NW 1/4 and SW 10 acres of lot 4 Sec 4. and SE 10 acres of lot 1, and NE 1/4 of SE 1/4 of NE 1/4 of Sec 5 Tp. 1 N. R. 19 E. and NW 1/4 of SW 1/4 of Sec 3 and NW 1/4 of SW 1/4 of NW 1/4 of Sec 16 Tp. 2 N. R. 18 East and being of the Government appraised value of __________Dollars. And the court upon consideration of said petition, and being fully advised in the premises, finds that one NICHOLAS BOHANAN, a full blood Choctaw Indian who appears upon the Roll of Choctaws by blood, opposite Roll No---------, and a resident of Pushmataha County, State of Oklahoma, on or about the _____day of ______1904, died intestate, seized of the lands above described, which said lands were allotted to him by the Chickasaw and Choctaw Nations, and conveyed to him by allotment and homestead patent, and that the said NICHOLAS BOHANAN was at the time of his death the owner, in fee simple, of the above described lands. And the Court further finds that JINCY ANDERSON, ELLIS BOHANAN, SIMPSON BOHANAN, ROBERT BOHANAN, GREEN BOHANAN, WILSON BOHANAN, WESLEY BOHANAN, MATILDA BOHANAN, NANCY BOHANAN are the sole and only surviving heirs at law of the said NICHOLAS BOHANAN deceased. The Court further finds that on the 22 day of January 1907 the said heir JINCY ANDERSON executed to W. H. ISHERWOOD for and in consideration of the sum of One hundred and thirty three 33/100 Dollars, cash in hand to her paid her certain Warranty Deed to the said above described real estate. said deed being ????? jointly with the ???heirs for a total consideration of $1200.00 and said JINCY ANDERSON being enrolled as a full blood Indian. The Court further finds that the deed was duly signed and acknowledged by the said JINSY ANDERSON that the consideration for the said deed is fully paid, and that the same is reasonable, adequate, and wholly satisfactory to the said heirs; and finds further that the said conveyance of the said real estate to the said W. H. ISHERWOOD should be in all things approved and confirmed. IT IS, THEREFORE, BY THE COURT CONSIDERED, ORDERED, ADJUDGED AND DECREED That the said conveyance of the said deed is fully paid, and that the same is reasonable, adequate, and wholly satisfactory to the said heirs; and finds further that the said conveyance of the said real estate to the said W. H. ISHERWOOD should be in all things approved and confirmed. IT IS THEREFORE, BY THE COURT CONSIDERED, ORDERED, ADJUDGED, AND DECREED That the said conveyance of the said above described lands by Warranty Deed dated the 22 day of January 1907, from the said JINCY BOHANAN to the said W. H. ISHERWOOD, his heirs and assigns, be and the same is hereby in all things approved and confirmed, and declared legal and valid.
