In the matter of the estate of SIDNEY BOHANAN, Choctaw New Born Roll No. 750 deceased. Comes now your petitioner, BEN FRAZIER, joined by his wife MARTHA L. FRAZIER, and respectfully shows to the Court That on or about the 31st day of January, 1920, SIDNEY BOHANAN died at his home intestate in Pushmataha County, Oklahoma; that at the time of his death and for a number of years prior thereto the said SIDNEY BOHANAN, was an actual resident of Pushmataha County, Oklahoma, and that this Court has the exclusive jurisdiction in the settlement of his said estate; that the said SIDNEY BOHANAN died unmarried, intestate and without issue. That the deceased at the time of his death was the owner in fee simple of a certain allotment of land located in Johnston County, Oklahoma, described as follows, to-wit: Lot 2 and N1/2 of SW 1/4 of NE 1/4 and NE 1/4 of NW 1/4 of SE1/4 and S1/2 of NW 1/4 of SE 1/4 and SW 1/4 of SE 1/4 Sec. 2 and SE 1/4 of SE 1/4 Sec. 3, and Lot 1 and SE 1/4 of NE 1/4 and SE 1/4 of SW1/4 of NE 1/4 and E1/2 of SE 1/4 Sec. 2, T. 3 S. R. 4 E. And SW 1/4 of NW 1/4 of NE 1/4 Sec. 33, T 1 N. R. 13 E. situated in Atoka County, Oklahoma. That the said deceased, appears enrolled as a full blood Choctaw opposite Roll No. 750, New Born. That the said deceased allottee was never married and never had any children; that his father and mother are both dead and that he left as his heirs at law, the following named persons, to-wit: BEN FRAZIER, petitioner herein, a brother, who is enrolled as a full blood Choctaw Indian opposite No. 5572, and JOSEPH WILKIN and MARY JANE WILKIN, brother and sister respectively, who are full blood Choctaws, but who were born since the closing of the tribal rolls. Your petitioner further shows to the Court that on the 9th day of March, 1920, for and in consideration of the sum of Fourteen Hundred and no/100 Dollars cash in hand to him paid by C. E. DUDLEY, the receipt of which is hereby acknowledged, your petitioner executed and delivered to the said C. E. DUDLEY, his certain warranty deed conveying unto the said C. E. DUDLEY his undivided one third interest in and to the real estate above described. That the consideration of the said deed is reasonable, adequate and in all things satisfactory to your petitioner. Wherefore premises considered your petitioner prays that this Court upon hearing hereon make and enter its order in all things approving and confirming the above deed and in all things declaring the same legal valid and binding. FRAZIER, husband and wife of Pushmataha County, State of Oklahoma, parties of the first part, in consideration of the sum of Fourteen Hundred and No/100 Dollars in hand paid, the receipt of which is hereby acknowledged do hereby Grant, Bargain, Sell and Convey unto C. E. DUDLEY of Pushmataha County, State of Oklahoma, party of the second part, the following described real property and premises, situate in Johnston & Atoka County, State of Oklahoma, to wit: An undivided one third interest in and to Lot 2 and N1/2 of SW1/4 of NE1/4 and NE1/4 of NW1/4 of SE1/4 and S1/2 of NW1/4 of SE1/4 and SW1/4 of SE1/4 Sec. 2, and SE1/4 of SE1/4 Sec. 3 and Lot 1 and E. situated in Johnston County, Oklahoma, and SW1/4 of NW1/4 of NE1/4 Sec. 33, T. 1 N. R. 13 E. situated in Atoka County, Oklahoma, Together with all the improvements thereon and the appurtenances thereunto belonging, and warrant the title to the same TO HAVE AND TO HOLD said described premises unto the said party of the second part, heirs and assigns forever, free, clear and discharged of and from all former grants, charges, taxes judgments, mortgages and other liens and incumbrances of whatsoever nature. Now on this the 9th day of March, 1920, the same being one of the regular days of this Court for hearing and approving deed claim deeds, this matter coming on regularly for hearing upon the petition of BEN FRAZIER, joined by his wife, MARTHA L. FRAZIER, praying for an order of this Court approving and confirming their certain deed to the lands hereinafter described, and the said petitioner appearing in person and there also appearing herein C. E. DUDLEY and paying into Open Court the price and sum agreed upon, and the Court being well and sufficiently advised in the premises finds: That on or about the 31st day of January, 1920, SIDNEY BOHANAN, who is enrolled as a New Born Choctaw opposite No. 750, as of the full blood departed this life unmarried, intestate and without issue at his permanent home in Pushmataha County, Oklahoma; that his Court has the exclusive jurisdiction in the settlement of his said estate; That at the time of his death he was seized and possessed of a certain allotment of land allotted to him by the Choctaw and Chickasaw Nations, and that same is described as follows, to -wit: Lot 2 and N1/2 of SW 1/4 of NE 1/4 and NE 1/4 of NW 1/4 of SE 1/4 and S 1/2 of NW 1/4 of SE 1/4 and SW 1/4 of SE 1/4 Sec. 2 and SE 1/4 of SE 1/4 Sec. 3, and Lot 1 and SE 1/4 of NE 1/4 and SE 1/4 of SW 1/4 of NE 1/4 and E 1/2 of SE 1/4 Sec. 2, T. 3 S. R. 4 E. situated in Johnston County, Oklahoma, and SW 1/4 of NW 1/4 of NE 1/4 Sec. 33, T. 1 N. R. 13 E. situated in Atoka County, Oklahoma. That at the time of his death the said SIDNEY BOHANAN, left no father or mother surviving him, but left as heirs at law, the following persons, to-wit: BEN FRAZIER, the petitioner herein, a brother, who is enrolled as a full blood Choctaw Indian opposite No. 5572, and JOSEPH WILKIN, a brother and MARY JANE WILKIN, a sister, who are full blood Choctaw Indians, but who were born since the closing of the Tribal Rolls. The Court further finds that on the 9th day of March, 1920, for and in consideration of the sum of $1400.00 to him cash in hand paid, the said BEN FRAZIER, joined by his wife MARTHA L. FRAZIER, sold and conveyed his undivided one third interest in and to the above described lands to C. E. DUDLEY, and has executed his warranty deed to said lands; which the Court finds from the evidence of disinterested witnesses is a fair and adequate consideration by this Court; and it appearing that such deed be approved and confirmed. It is therefore ordered, adjudged and decreed by the Court that the deed this day executed by BEN FRAZIER, and his wife MARTHA L. FRAZIER to the said C. E. DUDLEY, conveying an undivided one third interest in and to the above described lands, be and the same is hereby approved and confirmed, and in all things declared legal, valid and binding.
