All rights reserved. http://www.usgwarchives.net/copyright.htm Submitted to: http://www.usgwarchives.net/ok/okmulgee/okmulgee.html Transcribed & Submitted by: Darlene (Campbell) Scott ************************************************************************ Oakwood Cemetery aka 13th & South Morton cemetery Okmulgee County, Oklahoma Transcribed March 1, 2003 by Darlene (Campbell) Scott THE MUSKOGEE (CREEK) NATION-INDIAN TERRITORY Cemetery Deed To Okmulgee County OK Deed from Muskogee ( Creek ) Nation for Oakwood Cemetery THE MUSKOGEE (CREEK) NATION-INDIAN TERRITORY To all to whom these presents shall come, Greeting: Whereas, a townsite commission heretofore appointed and acting under the authority of the Act of Congress, approved March 1, 1901, (31 stat. 861) agreement ratified by the Creek Nation May 25, 1901, and the pro-visions of Sec. 13 of an Act of Congress approved June 30, 1902 Pub. 200 has appraised the lots in the town of Okmulgee, Muskogee ( Creek ) Nation Indian Territory; and Whereas, the plat of said town was approved by the Secretary of the Interior on the 6th day of November, 1901 and was duly placed on file; and Whereas, said commission has appriased all of the town lots in-cluded in said plat at their true value, excluding improvements, which appraisal has been approved by the Secretary of the Interior; and Whereas, the said commission has awarded the real estate described hereinbelow to Town of Okmulgee, Indian Territory ( for a cemetery )who has paid___( $100.00 ) Dollars, the full amount of the purchase price, into the treasury of the United States" to the credit of the Muskogee or Creek Nation of Indians, with the United States Indian Agent, at Muskogee, Indian Territory, and is, therefore, entitled to a patent; Now, therefore, I, the undersigned, the Principal Chief of the Muskogee ( Creek ) Nation, do, by virtue of the power and authority vested in me by the aforesaid Act of Congress of the United States, hereby grant, sell and convey unto the said__, Town of Okmulgee, and unto its successors and assigns forever, all the right, title and interest of the Muskogee (Creek) Nation, aforesaid in and to, the East Half of the East Half of the South West Quarter of the Northeast Quarter of the Southwest Quarter and the West Half of the West Half of the Southeast Quarter of the North-East Quarter of the Southwest Quarter of Section Seven (7), Township Thirteen (13) North, and Range Thirteen (13) East of the Indian Base and Meridian, in the Indian Territory, containing Five (5) acres, more or less, according to the United States Survey thereof Muskogee, (Creek) Nation, Indian Territory, and according to the plat thereof on file as aforesaid. Property is located on the corner of 13th and Morton street. Take US 75 or ( Wood Drive ) to 13th street, go west on 13th approx 1/2 mile. Property is located just West of the YMCA. There are three Military Tombstones in this cemetery. I have contact the VA to see if they will replace the stones because of the condition of them. I have documented the entire graveyard by taking photographs & a complete video of all the gravestones. For genealogical research. I have made a map of the grave yard and location of the gravestones. I have contacted the City Of Okmulgee for information in the Oakwood cemetery book and they have told me they can't locate the cemetery book. The cemetery is open on all four sides. There is one small fenced area on the inside of the southwest side of the cemetery that is fenced in. You can't see any gravestones inside because the leaves are so deep. Many of the stones are broken, many are over turned, some are face down. The cemetery is unkept except for a few time a year the city cuts the grass.
