Contributed for use in USGenWeb Archives by: Judy Michaels March 22, 2002 ************************************************************************ WOSSON TRIED AGAIN Murder Defendant Whose First Hearing Resulted in Jury Deadlock is Brought Into District Court Once More A district court jury was swiftly impaneled here today to try Albert Wosson, 69-year-old farmer of near Fairland, for murder. It was the second time Wosson faced proceedings for the alleged shotgun slaying Nov. 20, 1939, of Bill Martin, about 45, of Fairland. The first case last June resulted in a deadlocked jury, discharged by Judge W.M. Thomas after prolonged deliberations over the defendant’s fate. The state challenged three jurors while the defense excused one. The state used three witnesses, Dr. W[?]. B. Smith of Fairland, Dr. Wylie Chestnut of Miami, and Susie Wosson, daughter of the defendant, on the stand this morning. Perry Porter, defense attorney, said he would introduce 10 witnesses. Wosson, who has been at liberty under bond, allegedly shot and killed Martin in an altercation that occurred near the Wosson home one mile west of Fairland. Stella Wosson and Nina Wosson, other daughters of the defendant were slated to testify for the state this afternoon. Dr. Smith’s testimony dealt primarily with an explanation of the places a blast of a 12-gauge shotgun scattered over Martin’s body. Susie Wosson, who was near both her father and Martin when the fatal shooting took place, testified as to the circumstances of the incident and remarks exchanged before the gun was fired. The case was expected to reach the jury’s hands late today. The jury: O.C. Hadley, Frank Connolly, C.W. Fox, Harry Grover, H.S. Maupin and R.H. Davine, all of Miami; R.O. Denton of near Baxter Springs, Walter Freese, who lives west of Commerce; Vollie Odneal of Commerce; Charles Bauman of near Miami, Ralph Dawson of Afton and D. Harrison, south of Wyandotte.
