H. Hamilton, known as Judd Hamilton, of Indianola was accidentally shot by city Marshal C. W. Montgomery during a baseball game at this place Sunday afternoon. The bullet a .38 caliber broke the skull and part of the brain oozed out. His family was sent for at once and his wife, baby, nephew and brother arrived Sunday night. He was taken to his home Monday at 1:45 and died about 9:30 Monday night, was buried at Choate Tuesday afternoon. He never regained conciousness after being wounded. Mr. Hamilton had been drinking heavily and was resisting arrest when shot. He had gone to J. R. Creager’s private residence before going to the ball game and finding Mrs. Creager and children alone, ordered her, with (?) to get him something to eat. Mr. Montgomery, accompanied by Mayor C. M. Smith, went immediately to Eufaula, where he gave himself up to the authorities. There was a preliminary trial held Tuesday afternoon and bond fixed at $3.000 which was filled by W. D. Sadler, John Findley, W. J. Bunch, Mr. Rowton, Jno. Shipley, H. R. Russell and C. M. Smith. Mr. Montgomery is a quiet, unassuming man, never known to have any trouble with anyone. Highly esteemed by his neighbors and acquaintances, personally known to the writer for the past five years. A touching incident in connection with the accidental shooting Sunday, of Judd Hamilton by city marshal C. W.
