Contributed for use in USGenWeb Archives by: Kathy Pitts October 08, 2002 ************************************************************************ STATE OF OKLAHOMA PUSHMATAHA COUNTY SS IN COUNTY COURT IN THE MATTER OF THE ESTATE OF WESLEY BOHANAN, DECEASED; Comes now SUSAN BOHANAN, your petitioner, and respectfully shows to the court that she is a citizen by blood of the Choctaw Nation enrolled opposite No. 5512 as of the full blood, that she is the widow of ELLIS BOHANAN, deceased, and is the surviving mother and sole heir at law of WESLEY BOHANAN, deceased; That on or about the 26 day of January 1913 the said WESLEY BOHANAN departed this life intestate at Haskell Institute, Lawrence, Kansas while attending school at said place; that said WESLEY BOHANAN was a resident of Pushmataha County, Oklahoma when not attending school lived with petitioner at her home near Tuskahoma in said County and State where said WESLEY BOHANAN was born and raised; that letters of administration upon the estate of said WESLEY BOHANAN, deceased have been issued out of this court and this court now has jurisdiction of the settlement of the estate of said WESLEY BOHANAN, deceased; That said WESLEY BOHANAN was a citizen by blood of the Choctaw Nation enrolled opposite No 5517 as of 3/4 Indian blood; That said WESLEY BOHANAN at the time of his death was a minor, unmarried and left no issue, and that his mother, petitioner herein is his sole heir at law; that ELLIS BOHANAN the father of WESLEY BOHANAN died several years ago; That said WESLEY BOHANAN died seized of an estate of inheritance in fee simple in and to the following described lands (among other lands) to wit: The NE 1/4 of the SW 1/4; and the SW 1/4 of the SW 1/4 and the E 1/2 of the NW 1/4 of the SW 1/4 of Section 33 in Twp 8 North, Range 20 East of the Indian base and meridian, situate in Haskell county in the State of Oklahoma; That upon the death of said WESLEY BOHANAN said lands descended in fee simple to his mother, SUSAN BOHANAN, petitioner herein; That on the 10th day of March 1913 in the town of Antlers in said County and State your petitioner sold the above described lands, subject to the approval of this court, to O. R. BUSHFIELD for the price and sum of Nine Hundred Dollars; that petitioner has executed to said O. R. BUSHFIELD, his heirs and assigns, a Warranty Deed, conveying said above described lands, a coy of which deed is hereto attached and made a part hereof; that petitioner believes said consideration to be reasonable and adequate and the fair value of said lands; that the transaction is entirely satisfactory to her and she desires to consummate the same with the permission and approval of this court; WHEREFORE petitioner prays the court to enter its order ratify-confirming and approving said sale and declaring her deed to said O. R. R. BUSHFIELD for the price and sum of Nine Hundred Dollars; that petitioner has executed to said O. R. BUSHFIELD his heirs and assigns a Warranty Deed conveying to said purchaser said above described lands, a copy of which deed is attached to petition and made a part of the files in this cause; that petitioner has testified she believes said consideration to be reasonable and adequate and the fair value of said lands and that the transaction is in all things satisfactory and agreeable to her, and has prayed the court to permit her to consummate said sale and to enter its order approving said deed; and the purchase price now being in the hands of the court to be delivered to said petitioner; and it appearing to the court that it will be for the proper and best inetrests of said petitioner to approve her said deed; Now Therefore it is herby Ordered, Adjudged and Decreed by the court that the said deed of conveyance from the said SUSAN BOHANAN to the said O. R. BUSHFIELD, his heirs and assigns, conveying the lands hereinabove described, being the homestead allotment of said WESLEY BOHANAN, deceased, be and the same is hereby ratified, approved and confirmed, and in all things declared legal, valid and binding.
