CHARLIE COLBERT and I were married by a Choctaw preacher about the year of 1899 near what is now Nashoba. There was born to me and CHARLIE COLBERT only one child, named WEBSTER COLBERT. When this child was about a year old CHARLIE COLBERT and I parted, and I am informed that CHARLIE COLBERT got a divorce in the Choctaw court, and CHARLIE COLBERT'S father took the child WEBSTER COLBERT to raise. I kept this child for two weeks after our separation, and then CHARLIE COLBERT came and got the child, regardless of my protest and objections. I went to my brother's home and lived there. In May 1907 I was married to SIMEON CUSHER. The marriage was performed at Mena, Arkansas. In the year 1906 I went and got the child, WEBSTER COLBERT and took him to my brother's home, but CHARLIE COLBERT afterwards came and took the child away again. My brother's name is LYMAN HARRISON, he lives close to Albion, Oklahoma. Signed: SOPHIA CUSHER State of Oklahoma SS. Pushmataha County IN THE COUNTY COURT IN AND FOR PUSHMATAHA COUNTY, OKLAHOMA In the matter of the estate of WEBSTER COLBERT, deceased. Now on this day comes in person SOPHIA CUSHER, formerly SOPHIA COLBERT, and represents to the court that she is the mother of said WEBSTER COLBERT, deceased; that it has been stated to her and she believes the fact to be that there is a possibility that an interest in the estate of said WEBSTER COLBERT, deceased, upon his death vested in her; that this is a question which the courts have not yet determined; that for this reason there is a cloud upon the title to the lands of said WEBSTER COLBERT, deceased; that heretofore, one W. E. EVANS purchased of CHARLIE COLBERT, the father of said WEBSTER COLBERT, deceased his interest in and to said lands; that said interest she may have in and to said lands; that said interest she may have in and to said lands, and agrees to pay to Petitioner, upon the execution by her of a quit claim deed to said lands, duly approved by this court, the sum of One Hundred Dollars; that this petitioner has executed such deed and has attached the same hereto and petitioner believes the consideration named in said deed is fair under all the circumstances, and the same is satisfactory to her; wherefore she prays the court to approve said deed. Signed SOPHIE CUSHER The court having read the foregoing and heard the evidence offered and being fully advised in the premises finds that the consideration offered is fair and equitable and that the approval of said deed is for the best interests of all concerned; It is therefore ordered, adjudged and decreed that the deed hereto attached this day executed by SOPHIA CUSHER conveyed to W.
