Contributed for use in USGenWeb Archives by: Kathy Pitts November 6, 2002 ************************************************************************ STATE OF OKLAHOMA SS IN THE COUNTY COURT PUSHMATAHA COUNTY In the matter of the estate of JOSEPHINE BOHANAN NEE ANDERSON---dec’d; PETITION FOR APPROVAL OF DEED Comes now the petitioner NORA BRANAM NEE ANDERSON and respectfully shows to the court that she is the daughter and one of the heirs at law of JOSEPHINE BOHANAN NEE ANDERSON the above named decedant; and an adult citizen by blood of the choctaw nation enrolled opposite No 5578 as of the full blood; That said JOSEPHINE BOHANAN NEE ANDERSON the above named decedent was a citizen by blood of the choctaw nation enrolled as such opposite no 5577 of the full blood; That on the 21st day of May 1916 the said JOSEPHINE BOHANAN NEE ANDERSON departed this life intestate at her home near Sardis in Pushmataha County, Oklahoma; that said decedent was at the time of her death and for several years prior thereto had been an actual resident of pushmataha County, Oklahoma and this court has jurisdiction of the settlement of the estate of said decedent; That said JOSEPHINE BOHANAN NEE ANDERSON at the time of her death was the owner of the following described land, together with other lands not herein concerned, situate in pushmataha county, Oklahoma, to wit; The northwest 9.64 acres of lot four of section five in township two north and rangeineteen (really spelled that way) east; That said JOSEPHINE BOHANAN NEE ANDERSON the above named decedent left surviving her as heirs at law the following named persons and none other, to wit: her husband GREEN BOHANAN, who inherited an undivided one half interest in said above described land; and her daughter NORA BRANAM NEE ANDERSON, petitioner herein, who inherited an undivided one half interest in said land; That petitioner has sold her interest in said land to PARKE J. ANDERSON for the price and sum of fifty dollars; and has executed a deed to said purchaser, copy of which is hereto attached and made a part hereof; and said purchaser has agreed to pay into court for this petitioner said sum of fifty dollars; That petitioner has been upon said land and knows the location nature and value thereof; that she believes said sum to be the fair value of her interest in said land; that she is fully satisfied with said transaction and now desires with the permission and approval of this court to consummate said sale; Wherefore petitioner prays the court to enter its order ratifying said sale and approving petitioners deed to said purchaser. Notary Public My commission expires 2/23/1919 WARRANTY DEED KNOW ALL MEN BY THESE PRESENTS: THAT NORA BRANAM NEE ANDERSON joined by her husband LUSCIOUS BRANAM of Pushmataha County, State of Oklahoma, parties of the first part, in consideration of the sum of Fifty Dollars in hand paid, the receipt of which is hereby acknowledged, and do hereby Grant, Bargain, Sell and Convey unto PARKE J. ANDERSON of Haskell County, State of Oklahoma party of the second part, the following described real property and premises, situate in Pushmataha County, State of Oklahoma, to-wit: The Northwest 9.64 acres of lot four of section five in township two north and range nineteen east of the indian base and meridian; It being the intention hereby to convey an undivided one half interest in and to said land; Together with all the improvements thereon and the appurtenances thereunto belonging, and warrant the title to the same TO HAVE AND TO HOLD said described premises unto the said party of the second part, his heirs and assigns forever, free, clear and discharged of and from all former grants, charges, taxes, judgments, mortgages and other liens and incumbrances of whatsoever nature. Signed and delivered this 10th day of June 1918 NORA BRANAM NEE ANDERSON LUSCIOUS BRANAM STATE OF OKLAHOMA SS IN THE COUNTY COURT PUSHMATAHA COUNTY In the matter of the estate of JOSEPHINE BOHANAN NEE ANDERSON--dec’d; ORDER APPROVING DEED Now on this 10th day of June 1918 the same being one of the days regularly set aside by order of this court for the hearing of petitions for the approval of conveyances by full blood indians, there coming on regularly for hearing in open court the petition of NORA BRANAM NEE ANDERSON for the approval of her deed to PARKE J. ANDERSON conveying her interest in certain land hereinafter described; and said petitioner appearing in person and by attorney in support of said petition; and said purchaser appearing by attorney and paying into court said sum of fifty dollars, the consideration named in said deed; and U. S. Probate Attorney S. S. Lawrence having appeared and made no objection to the approval of said deed as prayed for in said petition; and the court having examined and considered said deed and petition and having heard the evidence of said petitioner and having heard the testimony of disinterested witnesses as to the value of said land, and being fully advised in the premises finds the facts to be as in said petition set forth, to wit: That petitioner NORA BRANAM NEE ANDERSON is the daughter and an adult heir at law of said JOSEPHINE BOHANAN NEE ANDERSON the above named decedent; and is a citizen by blood of the choctaw nation enrolled as such opposite No. 4378 as of the full blood; That JOSEPHINE BOHANAN NEE ANDERSON the above named decedent was a citizen by blood of the choctaw nation enrolled as such opposite No 5577 as of the full blood; That on the 21st day of May 1916 the said JOSEPHINE BOHANAN NEE ANDERSON departed this life intestate at her home near Sardis in Pushmataha County, Oklahoma; that said decedent as at the time of her death and for several years prior thereto had been an actual resident of Pushmataha County Oklahoma and this court has jurisdiction of the settlement of the estate of said decedent; That at the time of her death said JOSEPHINE BOHANAN NEE ANDERSON was the owner of the following described land situate in Pushmataha County, Oklahoma, to-wit; the northwest 9.64 acres of lot four of section five in township two north and range nineteen east; That said JOSEPHINE BOHANAN NEE ANDERSON left surviving her as her sole heirs at law the following named persons and none, other, to wit her husband GREEN BOHANAN, who inherited a half interest in her estate; and her daughter NORA BRANAM NEE ANDERSON (petitioner herein), who inherited a half interest in said estate. That petitioner NORA BRANAM NEE ANDERSON, joined by her husband LUSCIOUS BRANAM has sold and conveyed her interest in the land herein above described to PARK J. ANDERSON for the sum of fifty dollars; and has conveyed such interest by warranty deed, which deed is now before the court for approval; And it appearing to the satisfaction of the court, and said petitioner having testified that she believes said sum to be the fair value of her interest in said land; and that she is fully satisfied with said transaction and desires the court to approve her deed, that it will be for the best interests of petitioner to approve her said deed; And it appearing from the evidence that said sum is not disproportionate to the value of such interest in said land; Now therefore it is hereby ordered adjudged and decreed by the court that said deed from said NORA BRANAM NEE ANDERSON and her husband LUSCIOUS BRANAM to said PARK J. ANDERSON conveying an undivided one half interest in the land hereinabove described, be and the same is hereby ratified and approved and in all respects declared legal, valid and binding. A. W.
