STATE OF OKLAHOMA, PUSHMATAHA COUNTY. IN COUNTY COURT. In The Matter of the Estate of WILLIAM IMPSON, Choctaw by Blood, Roll No. #5193, Deceased. PETITION FOR APPROVAL OF DEED. Comes now your petitioner, ALBERT IMPSON, and respectfully shows to the Court: That on or about the 20th day of December, 1915, WILLIAM IMPSON, departed this life intestate in Pushmataha County, Oklahoma; that at the time of his death and for a number of years prior there to the said WILLIAM IMPSON was an actual resident of Pushmataha County, Oklahoma, and that this Court has jurisdiction in the settlement of his said estate. That at the time of his death the said WILLIAM IMPSON was seized and possessed of a certain allotment of land allotted to him by the Choctaw and Chickasaw Nations, and that a portion of the lands so allotted to him are described as follows, to-wit: W 1/2 of NW 1/4 and NW 1/4 of SW 1/4 Section 32, Township 2 South Range 15 East of I. B. & M. containing 120 acres, more or less, as the case may be, according to the U. S. survey thereof. That the said WILLIAM IMPSON appears enrolled as a full blood Choctaw Indian opposite Roll No. #5193. That at the time of his death the said WILLIAM IMPSON was a widower and that he left as heirs at law the following named persons, to-wit: ALBERT IMPSON, his son, who is enrolled as a full blood Choctaw Indian opposite Roll No. #5196, petitioner herein. LOUIS IMPSON, his son, who is enrolled as a full blood Choctaw Indian, opposite Roll No. #5197, and MAGGIE IMPSON, his daughter, who was a full blood Choctaw Indian, but who was born since the closing of the Final Rolls of the Five Civilized Tribes. That ALBERT, LOUIS and MAGGIE IMPSON were all the children that were ever born unto the said WILLIAM IMPSON, with the exception of one child named JINCY IMPSON, who is enrolled as a full blood Choctaw Indian opposite Roll No. #5195; that JINCY IMPSON departed this life unmarried, intestate and without issue of her body during the month of October, 1903. That some time during the month of October, 1918, the said MAGGIE IMPSON departed this life unmarried, intestate and without issue of her body, being a minor. That thereafter on or about the 25th day of March, 1923, the said LOUIS IMPSON departed this life unmarried, intestate and without issue, leaving as his sole and only heir at law, his brother, the said ALBERT IMPSON, petitioner herein. Your petitioner further shows to the Court that on the 9th day of May, A. D. 1923, in the town of Antlers, Oklahoma, your petitioner, joined by his wife, sold and conveyed all of his right, title and interest in and to the lands hereinbefore described to E. E. WESTMORELAND, for the price and sum of $300.00 and has executed to the said E. E. WESTMORELAND, his warranty deed, to the above described land, which consideration your petitioner believes is a fair and adequate consideration for said land. Wherefore, petitioner prays that upon hearing had hereon that this Court make and enter its order in all things approving and confirming and declaring legal and valid the deed this day executed to the said E. In The Matter of the Estate of WILLIAM IMPSON, Choctaw by Blood, Roll No. #5193, Deceased. ORDER APPROVING DEED Now on this the 9th day of May, A. D. 1923, the same being one of the regular days of this Court for hearing and approving dead claim deeds, this matter coming on regularly for hearing upon the petition of ALBERT IMPSON filed herein, praying for an order of the Court approving and confirming a certain deed executed by himself and his wife to E. E. WESTMORELAND of date May 9th, 1923, conveying the lands hereinafter described; and the said ALBERT IMPSON appearing in person, and the said E. E. WESTMORELAND appearing herein and paying into open Court the purchase price of $3.00.00 agreed upon, and the said matter being submitted to the Court, the Court finds: That on or about the 20th day of December, 1915, one WILLIAM IMPSON, who is duly enrolled as a full blood Choctaw Indian opposite Roll No. #5193, departed this life intestate in Pushmataha County, Oklahoma; that at the time of his death and for a number of years prior thereto the said WILLIAM IMPSON was an actual resident of Pushmataha County, Oklahoma, and that this Court has jurisdiction in the settlement of his estate. That sometime during the month of October, 1918, the said MAGGIE IMPSON departed this life unmarried, intestate and without issue of her body, being a minor. That on or about the 25th day of March, 1923, the said LOUIS IMPSON departed this life unmarried, intestate and without issue, leaving as his sole and only heir at law, the petitioner herein ALBERT IMPSON, above mentioned. The Court further finds that on the 9th day of May, A. D. 1923, the said petitioner, joined by his wife, executed to E. E. WESTMORELAND, for the consideration and sum of $300.00, cash in hand to him paid his certain warranty deed conveying all of his interest in and to the lands hereinbefore described, which the Court finds from examination of witnesses is a fair and equitable price for said lands. It is therefore ordered, adjudged and decreed by the Court that the deed this day executed by the said ALBERT IMPSON, joined by his wife, to E. E. WESTMORELAND, conveying the hereinbefore described lands, be and the same is hereby confirmed and approved and in all things declared legal, valid and binding. Done in open Court this May 9th, 1923.
