DAVENPORT, County Judge. THE STATE OF OKLAHOMA, COUNTY OF PUSHMATAHA} SS In the County Court of Said County and State. In the Matter of the Estate of ELIZABETH IMPSON now NOATABBE. PETITION. To the Honorable L. P. Davenport, Judge of the County of Pushmataha, Oklahoma: Come your petitioner FELIX NOATABBE, formerly the husband of ELIZABETH NOATABBE, who was allotted as ELIZABETH IMPSON, respectfully show to the Court: First: That on or about the 3rd day of July 1909, ELIZABETH NOATABBE, formerly ELIZABETH IMPSON, died intestate, at her home near Moyers in Pushmataha County, Oklahoma. That the deceased at the time of her death was a resident of Pushmataha County, State of Oklahoma, and that this Court has jurisdiction in the settlement of the said estate. That deceased at the time of her death was the owner in fee simple of certain real estate located in Stephens County, State of Oklahoma, which said real estate was allotted to her as a full blood Choctaw Indian, and that the said real estate so allotted to her is decribed as follows, to-wit: The N 1/2 of the N 1/2 of the SE 1/4 of Section 27, Township 2 South, Range 4 West of Indian Base and Meridian. That said deceased appears on the Choctaw Roll by blood, opposite Roll No. #5226. Second: That your petitioner FELIX NOATABBE was the husband of the decedent, ELIZABETH NOATABBE, formerly ELIZABETH IMPSON, at the time of her death, and that besides himself there was one other heir, to-wit: her child, DICK IMPSON, and that he, FELIX NOATABBE and DICK IMPSON are the nearest of kin and the sole heirs at law of the said decedent. Your petitioner further shows that on the 15th day of May 1912, in the town of Antlers in Pushmataha County, Oklahoma, State of Oklahoma, for and in consideration of the sum Niney-two and 90/100 ($92.90) Dollars cash in hand to him paid by JAMES MOYER the receipt of which amount is acknowledged, your petitioner executed and delivered to the said JAMES MOYER, a certain Warranty Deed, conveying unto the said JAMES MOYER his undivided one-half interest in and to the real estate above decribed, in fee simple. That the consideration of the said deed is reasonable, adequate, and in all things satisfactory to your petitioner. WHEREFORE, the premises considered, your petitioner prays that this Court enter its order confirming and approving the said conveyance to the said JAMES MOYER and in all things to declare the said sale and conveyance legal and valid. In the County Court of Said County and State. In the Matter of the Estate of ELIZABETH NOATABBE, formerly ELIZABETH IMPSON, Deceased. ORDER. Now on this the 15th day of May 1912 comes FELIX NOATABBE and files and presents to the Court his petition, praying for an order of the Court approving and confirming a certain deed of conveyance executed by him to JAMES MOYER on the 15th day of May 1912, to the following described real estate, to wit: His undivided one-half interest in and to the North Half of the North Half of the Southeast Quarter of Section Twenty-seven, Township Two (2) South, Range Four (4) West of the Indian Base and Meridian. And the Court upon consideration of said petition, and being fully advised in the premises, finds that one ELIZABETH NOATABBE, formerly ELIZABETH IMPSON, was a full-blood Choctaw Indian, who appears upon the Roll of Choctaws by blood, opposite Roll No. #5226 and a resident of near Moyers, Pushmataha County, State of Oklahoma, on or about the 3rd day of July 1909, died intestate, seized of the lands above described, which said lands were allotted to her by the Chickasaw and Choctaw Nations, and conveyed to her by allotment and homestead patent, and that the said ELIZABETH NOATABBE was at the time of her death the owner, in fee simple, of the above described lands. And the Court further finds that the said petitioner FELIX NOATABBE, was the husband of said decedent, ELIZABETH NOATABBE, formerly ELIZABETH IMPSON, and that besides him she left surviving her one child, DICK IMPSON, and that the said FELIX NOATABBE and DICK IMPSON are the nearest of kin and the sole heirs at law of the said decedent. The Court further finds that on the 15th day of May 1912, the said petitioners executed to JAMES MOYER, for and in consideration of the sum of Ninety-two and 90/100 Dollars, cash in hand, to him paid, a certain Warranty Deed to the said above described real estate. The Court further finds that the deed was duly signed and acknowledged by the said petitioners, and that the consideration for the said deed is fully paid, and that the same is reasonable adequate, and wholly satisfactory to the said petitioner and finds further that the said conveyance of the said real estate to the said JAMES MOYER should be in all things approved and confirmed. It is, THEREFORE, BY THE COURT CONSIDERED, ORDERED, ADJUDGED AND DECREED, That the said conveyance of the said above described lands by Warranty Deed dated the 15th day of May 1912 from the said petitioners to the said JAMES MOYER, heirs and assigns, be and the same is hereby in all things approved and confirmed, and declared legal and valid. Dated this the 15th day of May 1912, at Antlers, County of Pushmataha, Oklahoma. Signed by L. P.
