Case Number #192: PETITION FOR APPROVAL OF DEED OF FULL BLOOD INDIAN HEIR Comes now SUSIE COLE now IMPSON, a widow, Choctaw by Blood, Roll Number #5123, and shows to the Court that ALBERT IMPSON, Choctaw by Blood, Roll Number #5196, died intestate in Pushmataha County, State of Oklahoma, on March 4, 1952. That said ALBERT IMPSON, at the time of his death, was seised and possesed of fee simple title to the following described real estate situate in Pushmataha County, State of Oklahoma, to-wit: The NW 1/4 of Section 33, Township 1 South, Range 15 East. That at the time of his death, the said ALBERT IMPSON left no father, no mother, no brother, and no sister and left as his sole and only heir, his widow, SUSIE COLE now IMPSON, your petitioner herein, and that said real estate passed in fee simple to the said SUSIE COLE now IMPSON to the exclusion of all other persons, and that your petitioner is now the owner of the entire interest in said real estate and that on the 24th day of June, 1952, in consideration of the sum of $1,600.00, and subject to the approval of this Court she executed a warranty deed conveying to CLYDE KERR, the following described real estate situate in Pushmataha County, Oklahoma, to-wit: The NW 1/4 of Section 33, Township 1 South, Range 15 East. That the consideration for said deed is fair and adequate and is not disproportionate to the value thereof and it is to the best interest of said petitioner that said deed be approved. By virtue of Act of Congress of August 4, 1947, this Court has exclusive jurisdiction to approve said deed. Wherefore, petitioner prays the Court to make an order fixing the date of hearing of this petition and that notice of said hearing be given as required by law and said deed from petitioner to CLYDE KERR be approved; petitioner further prays that in the event she is unable to be present in open Court at the time of hearing that the Court will nevertheless approve such conveyance.
